An his punishment is maybe life in prison? He'll get off. He'll just get a lawyer screaming 'profiling'.

Is that not what he tried to do. Perhaps you believe the penalty should be more, and I have no qualms about that.

And, no lawyer is going to get him off, especially if he hit their radar because he was communicating with another terrorist, or suspected terrorist.

He was quite clear what he meant about WMD's, nuclear, biological and chemical weapons. He knew few would back his desire in invade Iraq if all they had were conventional weapons, let alone home-made bombs. And, he had plenty of people telling him he wouldn't find them.

Another point. Our definitions applying to civil and criminal laws in our own country need not conform to what is a military definition.
