Fine, they can't search your phone.  But the privacy agreement that you didn't read to download the latest fangled app allows that app to have access to  your address book, call log, Facebook wall, etc. Police can subscribe to those companies just like marketers and employers do. Axciom probably has most of your data on your phone now. All this was way before Ed Snowden was even thought of, and its legal.
