Just wondering, if you've been to successful lately to find the time to change the "ABOUT section" of you website from the blantant ripoff of Desert Divas to something a little more unique.

Seem to remember a time when a '.com' went somewhere strange, and a misplaced phone number as well.

JSR you know me, If I got somethin to say I say it. I don't hide behind aliases never have never will. I recieved 13 phone calls the day Alex's Playmates launched with a cheap copy of Desert Divas and our phone number posted on their site. All from hobbiest who thought we were affiliated. After contacting Playmates i was told it would be changed, the number went away but the lack of creativity stayed. They even went so far as to send TER an email stating I stole their site description for AZC (AZC was created by scott in feb 06) long before Alex was a twinkle in a review's eye.  I guess I should just fall back on the old saying " imitation is the best form of flattery".

Sounds to me you may have a trademark infringement case as well in addition to a few other bases of liability. Your description of the copying of the website and hobbiests calling to ask if the new business was affiliated are the crux of a trademark case. Basically, if the creation of the identical web site gives the appearence of both businesses being related you are conceivably being harmed. Typically the most valuable thing to be gained in a trademark infringement lawsuit is a court order forcing the other company to change their website so it no longer appears the two companies are related. You also may be able to recover economic damages (tougher to prove) based on any loss of business due to the identical websites. Good luck in resolving this matter!!!
