And because we operate mutiple services it is not unusual for many in the Valley to think we are connected due to the name....our post is to clarify we are not connected in any way...\

I think even if you were to trademark your name the "USA" could still be used in conjunction with another name....just my thought!!

value comes from the reputation that the business has built up over time....otherwise there would be a macburger or macsomething on every corner...

they can name the service whatever they want but it emplies a connection just like we had to make clear when Scott opened AzConfidential that it had nothing to do with AzElite or AzMystique...
Since we were the first to use AZ in a service the public naturally could be confused.......

I posted to clarify what i was being asked by clients...especially since they knew Britt worked for Mystique......

if they named themselves AZGeishaUSA, that might be a cause for concenrn.  Don't think you can trademark names such as USA, AZ, etc

I doubt that would ever happen...but let me hire two new ladies and name them marykares or susie kares or whomeverkares and see if you have the same feeling or if you would feel you were infringed on....

If i tried to trademark anything it would be MystiqueUSA......and then I am not sure using USA it would happen

The whole issue is how people take a business name and try to capitalize on that name and reputation starting out new...it happend to Divas not to long ago and that agency is now no longer on the scene...

blue the issue is putting the USA on the end of their name just as putting AZ on the front could cause confusion...i changed Mystique's name from AZMystique to MystiqueUSA just to avoid the confusion with AzConfdential...

Numerous elements must be established in trademark litigation. However, though I do not believe a trademark infringement action would succeed, there may be other causes of action that could be asserted. I belive an action for trademark dilution may be applicable under these circumstances. Rather than cut and paste paragraphs of information, I provided a link which offers a solid explanation of trademark law.

It would be simple common courtesy for them not to seem affiliated with your agency with the "USA" tag at the end.  Maybe they can call themselves PhxGeishas, Geishas of Phx, GeishaINT..

Needless to say, I know how you feel. There is still some joker out there with an alias Blue Ice Man posting on the Vegas and Minneapolis board.  I think it is lame but what can you do.

You seem to provide an above par service and your reputation is all you have so why have it confused with someone else.

Terri might like it if yu came out with marykares or susiekares.  It would give me the opportunity to likely crown them with the title Mother Hen. We can only have one of those and it has to be someone who Kares.

If you'll recall, MystiqueUS was formerly MystiqueAZ.  Agencies change names from time to time, and they stated that some existing clients had called wondering if their name had changed again.

Another, much less-reputable Sarah got a bad review a few months ago.  I felt it necessary to post something, just in case there was any confusion.  A good name is of so much value that anybody who has one should guard it carefully.

Mystique's post wasn't offensive to the rookie agency...just protective of their own goodwill in the community.

That is a easy answer...any time a girl moves from one service to another her reviews can move with her if TER is ask to move them....
