Thought I would share some info...A friend in LA was a newer provider busted on a P charge a couple months back. Because of her day job she has been fighting to reduce charges...She's never been busted for ANYTHING but one of the things the prosecutor is "holding" against her most is that she HAD A WEBSITE.. The prosecutor is defining that as a "sophisticated operation"...so basically in his eyes, she could of been working the streets and they would be more willing to deal lesser charged BUT becuase she was ORGANIZED and trying to BE SAFE...they are being HARDER...
Prosecutors say lots of things to intimidate people to get them to plea. They hide or distort the truth, they do not reveal facts, they do not let you know your rights or possible arguments.
It is an adversarial process and she needs a good lawyer.
No intelligent judgment can be made about the perils of using a website from this post. This is double hearsay at least from two apparent non-lawyers and the post is too vague to be understandable.
The best advice is for anyone with a website is to personally read all of the applicable laws and make sure you are in full compliance, and then consult with a lawyer who is savvy in this area and see if he agrees.
