and it was certainly not our intention to infringe on any other agency's name. And to show you that we are serious about this, we typed in to the address bar "mystiqueusa.com and mystiqueusa.net" The mystique site does not present itself. Actually, one site is a Fabric oriented site and the other is redirected to the aol search page. Then we realized that mystique does not use USA but US. Hmmm, makes you wonder why this was even brought up. Again, thank you to those that have supported us in our early stages.

Our website clearly says MystiqueUSA....and our TER handle clearly states MystiqueUSA...

We settled on a url of MystiqueUS because we wanted to be dot com and not dot net just as you found GeishaUSA.com was not available..

When you posted we received several phone calls and emails asking if we were affiliated with this new service.....especially since Britt had worked at Mystique and in the past we had supported others whom had worked with us in doing their own thing.....

The trademark was started by another and was never involved in our original post nor was it an issue....

The issue was the similarity of the name by adding USA to the end....

We simply clarified to those who might wonder that we are in no way affiliated with you or anyone connected with you....

That should answer your question of "why this was even brought up"....although knowing who is involved and where the web site orginated I am sure it was probably intential......

Who are you? You know better than to put USA tag on the end of your name. Ride my coat tails if you must but dont expect respect from any of our agencys. Bad idea to come into this biz using 1 of our old girls and tagging yourself USA. Can't wait for the hundreds of phone calls asking us if we are tied to you. Feel free to call and ask that question, my responce will NOT be flattering.

Given that half your lineup (the two you show on your site, anyway) used to WORK at Mystique, and your agency name is just similar enough to imply affiliation, of course that was intentional on your part-no need to insult our collective intelligence by feigning innocence.

What better way to get started than to "unintentionally" generate confusion in the marketplace and build your business on the back of a respected and established agency.

It's a smart business move, but you should have known you were gonna get called on it. You took the risk, now deal with it, cause there's no such thing as bad press.

Just bad service, and the jury's still out on you in that regard-time will tell. It always does.

Given the number of sattelite agencies and affiliations Mystique has handed out over time, it's not unreasonable for the regular hobbyist to believe GeishaUSA is just another clone, and it's emminently practical for Mystique to make sure the record is straight in that regard. It is THEIR reputation after all, they should protect it.

Who knows-Maybe you'll take all this new found attention as an opportunity to showcase your top-notch service, and actually EARN your own place of esteem in the community, rather than trade on another's.

But my gut tells me we won't be hearing about your one year anniversary celebration-but hey, call me a cynic.

As I stated in the original post addressing this issue, there is substantial likelihood that GeishaUSA could be found liable for trademark dilution. Crucial to my point is the fact that MystiqueUSA has been contacted by several individuals inquiring whether GeishaUSA is affiliated with MystiqueUSA. The mere fact that USA is utilized in both of the agency trade names is only one factor considered in this analysis. More importantly, the source of confusion arises from a fomer employee of MystiqueUSA presntly being employed and featured on GeishaUSA's website.

That being said, I am not advocating the initiation of gratuitous litigation to resolve this matter. Perhaps GeishaUSA posting a disclaimer on their site stating they are in no way affiliated with MystiqueUSA and its subsidiaries will put this dispute to rest once and for all? In the evnt that the parties are unable to reach an amenable conclusion to this matter, to I will gladly offer my dispute resolution skills for free so the community can be restored to some degree of tranquility.

they cant use usa without being accused of riding your coattails..

..."mystique" is the name you have built.. you are known as "anything mystique or mystique anything"... you are not known as "az anything or anything usa"  

if the agency in question was truly trying to rip off your name they wouldve have used the word "mystique" in their name, which by the way since you have no trademark, would be clearly within their right to do so but they did not ...

because clearly they could give a rats ass about your name and because clearly they were using usa for the same reason you and any other business in the land of the free uses it. .

because THAT is where they are located.  


and geishaaz looks dumb now doesnt it ? doesnt look sexy at all. i can totally see why they chose usa.

did Geisha need az or usa in their name....they could have just been Geisha Girls....A former companion of Mystique, a former client who was banned for trying to start a agency before and the web site he built just re done and all of a sudden they pick USA...yea right...


I could have named Platinum Encounters Platinum Club but I did not as that would have been a afront to Taylor and Club TLC...you see Anna it is about respect...or maybe you don't understand that part of this business, I don't know you so I don't know...but I for one would not insult either Taylor, Rose or Paul by using part of their service's name in any venture I started in this business...

Guess I come from the old school....but then again I am ole so I have a excuse..

my name is ana not anna please dont confuse me with swedish anna. yes it has happened in the past.

and we've never had to squabble over who was here first.  

you're right i dont have a clue as to why they chose usa..  check the yellow pages under escort listings you'll see lots of them start with az and end with usa.  its a very logical business decision to have your geographical location in your business name.  

i know something about respect. i also know something about grace.

when you are a successful business you arent afraid to welcome competition as it only serves to improve the industry as a whole.

if they changed their name from azmystique to mystiqueusa but use the url mystiqueus ... then
