So, I was thinking that if pornography is legal why isn't prostitution?  What if the "act" that we are all seeking is masked under the guise of say pornography.  Tell the provider that you are interested in her services, but not for sex per say, for pictures of sex? The money exchanged is for the pictures of you in the act not the act itself.  If the provider is reluctant to play this game you could even let them know that you are a terrible photographer and many times don't even put batteries in the camera. ( sorta a big WINK WINK) would this approach avoid the legal ramifications of paying for sex?

The short answer is that LE isn't going to buy it and you're going to get busted.

Now, on to the trial:

You are on the stand and the prosecutor starts asking you how many films you have made so far, where are they exhibited, where are your business records, how much profit, etc. have you made.

In short, he's going to show that the whole "porn" theory is just a sham and what you actually had there was sex for money.

I don't see any jury or judge buying.

You would have to:

Get a license;

Provide a 1099;

Maintain Identification Records according to several Federal, State, and Local laws;

Be willing to take the laughs and humiliating verbal abuse for standing up in open court and trying to sell the story that you were "just making a porn" because you WILL be busted.  A defense is only good for court, not the police - they don't care what you have to say. (better to say nothing at all but your name).

Good luck trying to find a provider who will do all of the above with you.  If you do, she probably wouldn't be smart enough to carry it off if you get what I mean.

Research, stay with well reviewed ladies, and be aware of your surroundings.  That is how to best avoid a bust.

Any legal porn shoot is licensed and permitted. Contracts and model releases are signed and records are on file. Actors are paid and 1099's are issued.
The fact is some porn shoots are even illegal...they just don't get caught!

There is no substitute for the simple act of choosing wisely and screening carefully.  As many of us have mentioned before, the best way to avoid LE is not to wind up in a room with them to begin with. If you walk into a sting your camcorder is not going to save you.
