Please help. Provider friend has a BS profile on another site.angry_smile

So, a regular of mine who's also become a genuine friend is upset with this other site, but I'm afraid it may be one of those places we're not supposed to say the name of here. It's an erotic site run by a bunch of damn dirty apes, can I say that? I really have no interest in breaking rules and discussing the competition. I don't consider them competition to TER because the whole site is nothing but BS. Can we talk about them to say how horrible they are and they ought to be shut down? I hope this is okay?

She has a profile there, and it's full of a lot of bad information about her. Wrong ethnicity, hair length and color, etc.  What's got her really upset though is a ton of inaccurate information regarding what she does and does not do. This really has her quite upset and emotional. She's not FS and doesn't need guys calling from the wrong marketplace.

Along with all the bad info, they have her real contact info and her pics, which they put their own watermark on as though they own them. That's really infuriating!

There are five reviews on her profile there. At least four of them were copied verbatim from here, including the one I wrote. Each review has it's own sort of brief profile info next to it, instead of one overall profile like here. Strangely, the info with my review is one of the ones with the wrong hair and ethnicity on it, which obviously didn't come from me.

She wrote the site asking to be removed and didn't get a response. Please, does anyone have any advice on how to get her off of there? She really just doesn't even want to be on that site, it's just slimy. She'd rather be gone from there than just get the info corrected. If you know anything please pass it along. PM is fine if you don't want to talk here.

I would also very much appreciate a response from admin on this. The terms of service here state that once a review is submitted, it becomes property of TER, to do with as they please. Understandable. This other site is blatantly stealing your intellectual property. I'm curious, are you cooperating with them, powerless to legally stop them, or indifferent?

Search Newbie and General for "DMCA" (Digital Millennium Copyright Act). I think that would apply to her pictures to which she can probably claim copyrights. Written reviews and other written content belongs to the author (or website).  You CAN do DMCA on your own, but maybe it's worth it to ask a lawyer.  

Then, maybe you can argue that they don't have a valid model release. Even w/o the associated legal mumbo jumbo, someone is not allowed to use someone else's likeness for profit w/o permission. That mostly applies to celebrities: a paparazzi shot of a celeb in a BrandName hat or coat or shoes can be used as news but the BrandName Company can't use that pic in their ads. But I believe it also applies to non-celebs, depending on how detailed it is.  

Someone posted here that she tried telling a site using her pics that she was a minor when the pics were taken, so the pics were illegal and in violation of 2257. Even though she was an 18-20 and the pics could have passed for being sub-adult, they didn't buy it. (But she eventually succeeded. I just don't remember how.)  

If the website doesn't act, maybe you can go over their head (e.g., if they ignore the DMCA) and contact their ISP.

...Admin. directly using "Contact Us." Don't expect them to read your post and reply here.  They do take use of their reviews seriously; providers are not allowed to post their reviews word-for-word in their ads.

The OP seemed to be talking about stolen pics and fake reviews alleging that his friend (the Provider) does things that she does not do.  

"Our" reviews published by TER are the copyrighted property of TER. If the un-named site is using TER copyrighted material, that could bring TER and their lawyers into the picture. If the un-named site stole your three reviews that is probably just the smoke over a firestorm of many, many more illegally used (copied) reviews. I think you (erik) should Contact Us TER Admin with the links and ask if they want to dig deeper into copyright violations. A victory could either win a big money settlement or maybe just shut down the offending site

Yes, we are talking about stolen pics and one review that describes her doing things she doesn't do.  

There is also a profile similar to those here, with like a quick run down of details. Except for the stuff that's bogus, I'd say that is copy pasted from here. The other four reviews there for her were literally copy and pasted from here, with the user names changed. (Although one of them just barely changed)

So yes, it is copyright theft in terms of the provider pics, and it is copyright theft in terms of TER's copyrighted material. It's both. TER and its lawyers should definitely be at the table.

I'm sure you're right, I've probably found only four of thousands if not hundreds of thousands of stolen reviews.

I will send links to the admins here as you suggested Erik do in his case.

My profile and photos are on numerous sites, without my permission, and no matter how many times I contact these companies, my information remains.  Honestly, I've just given up and ignore them...otherwise it would stress me out too much!

I personally have sent out emails to remove my information there... but has been pointless so far!

Hey, thanks for that info.

Looks like it's at the bottom of just about every page on the site. I just read it and I'm sure it will be helpful. Doesn't quite make 100% sense to me though. It keeps saying gather all this info and send it to the "designated copyright agent listed below" but, there is no such agent listed, below or otherwise. No name, no physical address, no email address. I'm sure they would prefer we all gather the appropriate information and send it right up our ass.
