Does LE care if...

and the answer is always the same.

First and foremost, LE will bust you no matter what if you get in the same room with them.  First amendment scholars, they are not.

Your defense will be long, costly, and arduous.  You will be asked what proof there is that you have a porn business.  Do you have your business permits?  Have you filed taxes?  You may find yourself facing charges for failure to run the business properly.  Those could be a lot more serious than the original solicitation charge.

Short answer:  It's never worked, and most likely it never will.

Just be very careful and discreet in how you conduct your hobbying.

You videotape the encounter and post it to a paid website. Does it then become a First Amendment free speech issue? It seems like some guys are able to pull this off, like in casting couch or exploited teens dot com. I noticed they don't show their faces. Is this due to their fear of LE? Anyone have any ideas on how they find the women and how much they pay? I can't believe how cute some of them are.

gone through all the proper steps required to make a professional film or video:

- Get the performer's real name and paperwork, model releases, etc.
- File/obtain licences, etc. with the necessary govt. agencies
- Document all payments, tax w/h, etc.

That's just the beginning. I'm sure someone on the net has list what it takes. Those POV pornos aren't simply a matter of some dude taking a camcorder to his $300 escort session and throwing it on the web. Sorry.

Of course they are cute, they are all budding pornstars! :D Some girls get their start in those videos, but please don't believe that any of them are innocent college girls, aspiring soap opera actresses, or unsuspecting real girlfriends. It's a huge franchise ran by two companies in the SF valley. They bring in new talent and film them in various first timer / casting couch / college coed, etc scenerios. Look at BP in the adult work section for proof. You can also post there and find a cute girl in the $500 range for an hour of camera friendly fun. As far as LE goes, if they arrest you you are no better or worse off than if you were not recording.

I know the auteur/douche is from NJ, and the original ones were shot there. It could be that he's moved it out to Calif. more recently.

But that's not one of the big ones. When you look at the sites that are known for the "teen exploitation", "casting couch", etc genre, look at the footer. They are all owned by the same douches (as you so well said). I've had the misfortune of meeting both but luckily did not end up in any of their videos. The pay is crap. lol

and I thought it was considered some kind of pioneer for that kind of porn. I have no idea what the big ones are. I've seen a few that were shot in Florida, too.

Not to take anything away from the main point that POV porn isn't as easy for anyone to do in their own neighborhood as it's made to look. That's just the illusion that they contrive to make it appealing.

I disagree, Mr F. If you really run it like a business, which means when you get there, you ask for photo ID, present the lady with a contract and release, and absolutely refuse to do anything, no act, no money, no nothing until she proves who she is and signs the release with a witness (that being the cameraman you brought along), I imagine that would pretty much kill any potential solicitation prosecution. Not saying they could not haul you in, make your life miserable and cost you a lot of money if they wanted (and in some jurisdictions I am sure they would in order to discourage those danged pornographers), but ultimately they would be hard pressed to convict you.

The key would be to make the release, payment, and need for ID a part of the original email correspondence, too. If you are trying to produce homemade porn, act like it is a business. If you do that, my guess is that LE, and most providers, would blow you off.

On the other hand, if you want to pay a provider, secretly or not so secretly videotape her without any contract, release, or ID, posting the video is not going to help at all. It just makes you a John and sleaze.

Not a lawyer.
