Judge Resigns Amid Reports of Discovery on Computer

A Manhattan Criminal Court judge resigned last week after court officials discovered what may have been pornography on his work computer, according to law enforcement officials.

Court officials turned over the evidence to the Manhattan district attorney’s office. Its discovery on the computer of the judge, James D. Gibbons, came as part of routine monitoring of courthouse personnel, said one of the officials, who spoke on the condition of anonymity because the investigation was continuing.

Judge Gibbons could not be reached for comment on Thursday evening.

The judge did not give a reason in his resignation letter for leaving, said David Bookstaver, a spokesman for the Office of Court Administration.

Mr. Bookstaver would not say whether there was an investigation into Judge Gibbons, but he said, “If we become aware of a possible criminal act, we refer such matters to the appropriate law enforcement authority.”

Erin M. Duggan, the communications director for the Manhattan district attorney’s office, declined to comment.

The news came as a shock to those who know Judge Gibbons, 47. They described him as one of the most intelligent judges in Manhattan Criminal Court.

After spending 13 years in the Manhattan district attorney’s office, he was appointed to the bench in 2001 by Mayor Rudolph W. Giuliani. Judge Gibbons graduated from Harvard Law School in 1987.

One colleague said he had the air of a United States Supreme Court justice and could easily rattle off legal decisions.

Judge Gibbons resigned on Aug. 17, weeks after his companion, a defense lawyer with the Legal Aid Society, gave birth to their son. Last month, courthouse personnel held a baby shower for the judge in the courthouse, another judge said. Patricia Bath, a spokeswoman for Legal Aid, said Judge Gibbons’s companion had told officials about their relationship and did not argue cases before him.

Judge Gibbons has presided over several high-profile cases. In 2006 he threatened to throw the supermodel Naomi Campbell in jail after she missed a court hearing on an assault charge. He presided over a hearing in 2008 in which David Tarloff, who was charged with the murder of an Upper East Side psychologist, was declared fit to stand trial.

I don't see why it's a big deal.

He should have been smarter about using his work computer for fun.

But if everyone in the pics and videos was a consenting adult, who cares?

And about his have a kid, I always knew judges were people too, again, so what?

This highlights a problem with society, not with this judge.

At a time when all the world knows that employers frown on pornography in the workplace, and all the world knows that employers check their computers for same, Gibbons loaded his desktop with sexually explicit images, some of females whose ages are yet to be determined.

Gibbons' doing so in a court system that monitors computer use and would have zero tolerance for porn on the bench or in chambers serves only to suggest that "id" is the true root of the word "idiot."

So, too, the fact that Gibbons first drew the attention of his superiors by fathering a love child with a Legal Aid lawyer who had argued cases before him. That's kind of hard to overlook, no?

So he has fled from the courthouse and into a New York trivia hall of fame.

As Sydney Biddle Barrows is the Mayflower Madam and David Berkowitz is the Son of Sam, James Gibbons will forever be the Porn Judge.

I'm sure you do the proper background check for all the girls to make sure that they are all of legal age before watching them on the interwebs, right?

One correction: the attorney with whom he fathered a child NEVER argued a case before him. Reading comprehension: use it.

Right now, the only thing he's guilty of is stupidity of surfing porn at work. I find it difficult to condemn him for looking at porn since I actually have a folder on my computer named "Documents/porn".

If you want to condemn an idiot, please look to the guy who is on his moral high horse on this particular website.
