The Supreme Court recently (June '10) made significant changes to the Miranda law.  

‘The courts conservatives used their 5-4 advantage to rule that suspects must break their silence and tell police they are going to remain quiet if they want to invoke their "right to remain silent" and stop an interrogation, just as they must tell police that they want a lawyer.’   In part,

    The high court said for the first time that a suspect's request for a lawyer is good for only 14 days after the person is released from police custody. The 9-0 ruling pulled back from an earlier decision that said that police must halt all questioning for all time if a suspect asks for a lawyer.

    Police can now attempt to question a suspect who asked for a lawyer — once the person has been released from custody for at least two weeks — without violating the person's constitutional rights and without having to repeat the Miranda warning.

    "In our judgment, 14 days will provide plenty of time for the suspect to get reacclimated to his normal life, to consult with friends and counsel and to shake off any residual coercive effects of his prior custody," said Justice Antonin Scalia,  who wrote the majority opinion.

    But Justice Sonia Sotomayor said the majority's decision "turns Miranda upside down."  Criminal suspects must now unambiguously invoke their right to remain silent — which counter intuitively requires them to speak," she said. "At the same time, suspects will be legally presumed to have waived their rights even if they have given no clear expression of their intent to do so."

Should you ever be in that situation, use it heavily.  LE has to prove their case.  Don't make it easy for them.

I think you are all assuming this decision is aimed at only the prostitution trade. How do you feel every time a killer ,rapist,thief,etc. gets off.Believe me,the people the courts had in mind were these very perps. I for one, am thankful that the police have one more weapon in the war against real crime.every day you hear about some person getting off because he hadn't heard his Miranda rights.Who the hell in this country doesn't know their rights!Give me a break!

I have lost count of the number of times I've heard someone in court say, "The reason I did it was because . . . . " not taking into account that all he or she is really doing is admitting, under oath, that they did it.  The same flawed reasoning applies to the absurd hope that the guy who is hot to arrest you will do everything he can to help.

And you would get no complaints from me if LE did what they should be doing and just go after true criminals instead of wasting resources going after escorts and hobbyists.

“Prostitution” trade.  Who said anything about prostitution?    



I feel the leaders of this country have become delusionally out of touch with its citizenry.  When you have a Supreme Court justice basically acknowledging that there is a “coercive” element in being detained, what’s that about?  The tiring argument so often mentioned when an issue is brought up regarding citizen rights, somebody has to bring in the criminal behaviors, as mentioned, that I am certain the majority of  human beings in this country are against and would never condone.   That includes me.  

And yes, you can be certain that there are many U.S. citizens who may only have a vague idea what Miranda even means.   The police are intimidating; they are legally entitled to lie.  Coercion in LE?  Well, even Justice Scalia admitted it.

LE has an incredible amount of power as officers of the courts in deciding whether you are doing anything illegal, or not.   After all, if the police officer doesn’t think there is a problem, then nobody else in the ‘system’ will even know about you.  And you better not piss off that cop if you are detained, because they can legally use force, too.

The only way the criminal court system can work is if a simple premise is held as valid; namely, that when a police officer testifies in court, he is always telling the truth.  Now, we all know that they are human beings and some of them lie.  It is a statistical certainty.  If you now add in the element that your right against self-incrimination, in this case speaking without counsel present to advise, is a transitory, limited, and temporary phenomenon, the potential for abuse is increased.

For those who are in favor of the police "having the tools to get the job done," remember that being wrongfully arrested is possible (sorry Mr. Hauptman, we needed to fry SOMEONE for Lindberg's kid).  At that moment, I don't care if one is arrested for solicitation or murder, the people who despise the system "favors" criminals (um, they're not criminals until convicted) will be the first people to demand their lawyer (those despised trial lawyers that coddle criminals and fool juries).

Right!  Shouldn't LE be trying to get real criminals?   All their doing when they bust men is giving the community a false sense of security that their town is now safe from crime!!!  All because two consenting adults aren't able to do what they want!  WOW!  HAND CLAP to you LE.

The money that goes into the hobby comes full circle!  Escorts spend that $ in the communities they live in and visit!  Plus, they help friends and family in need!  What the hell?      

I can't think of a better way for two people to help eachother out!!!
