Shooting private sex tapes of your partner and you I would doubt qualifies as porn unless you market and distribute it. Are you trying to avoid the technicality of paying a woman for sex but instead you're just making amateur porn for pay? That's been tried before and I'm afraid the judge isn't going to buy that story.

I believe California has records laws for commercial porn.  Like you have to document ages of participants, etc.

Where ever privacy is inferred you cannot record or film video without permission. Especially as in a home or hotel room when clothing is off.   It clearly says on a girls TER profile if they allow filming or pictures or not.  Are you informing these providers that you are filming them or getting their permission? And no the laws are not just against posting revenge porn, there are laws against creating it without the persons permission.  Peeping Tom's on steroids would have a holiday.
