As of the news release, he is still a tenured faculty member in the Communications department. It is *extremely* difficult to fire tenured faculty and I do mean extremely difficult. The role of Chancellor is administrative and that's a completely different contract. Most colleges and universities on the admin side have a "morality clause" that stipulates the employer has the exclusive right to end a contract in the event an employee engages in behavior that may be harmful to the employer's image.
In addition, and this information isn't known yet, if he was living on University property (re: Chancellor's House), he was more likely than not using the University's IT network which literally tracks everything a user does. If he was making money using the University's network that probably also violates a portion of his contract.
His potential lawsuit citing the 1st Amendment and academic freedom most likely won't stand with respect to his firing as Chancellor. Now, if they go after his tenure, he may have a leg to stand on. ba dum tss
As far as his position on the faculty goes, given the overall state of relations between the U of W system and the Republican legislature, this will become yet another bone of contention.
Wisconsin is an "at will" state, so it will all boil down to contractual obligations. "Freedom of expression" is not included in the exemptions from "at will" (such as race, gender, religion ...)
