Nothing legal about being a sex worker.  The health code is there to mitigate the transmission of infections - not to make prostitution legal.

Note that any person who engages in sex with someone else knowing that they have a contagious infection is guilty of a federal and state felony punishable by prison time.

In Regards about the post of Bars Closing on March 30,health department raided hookers bars according to something I read in TJ Zona Norte pulled 230 sex worker out of circulations around 1:30am as health department swooped down on checking hookers to see if they were carrying health cards.In addition to the mass arrest five night club was closed until further notice: Valintinas, Hong Kong, Chavela's and Adelitas.The received an fluorescent ''clauserado'' across their doors. By Tuesday afternoon the building was inspected where women go receive health inspection in order to go back to work legally as sexoservidoras was busy with women trying to update their health card.Employess of the shut down bars and night clubs hovered around side walks, hoping for rapid  reopening of the establishment to be granted by city Hall.

I don't believe La Valentina was ever closed although it did say so in some newspaper accounts.  I was in there the next night when the others were closed.  

Basically AB, HK, LC, and Siete de Copas lost one day of business.

There's nothing legal about being a hooker in Tijuana.  I'm afraid you're sadly mistaken, mate.  That being said, I wish more in the escort scene followed the protocols that the women in the static locations do.  You're very lucky to find an outcall or incall that has their card dated within the last 21 days.

You're misinformed.  

Prostitution is governed by state and local laws and in Tijuana, prostitution per se is legal. There are, however, restrictions on who can be a prostitute and how prostitutes can ply their trade.

Making money of the earnings of a prostitute is illegal.  Pimping and pandering, running a brothel, etc. are felonies.

It's a violation of the administrative (health and safety) code for a prostitute to work without a health card.  A prostitute cannot solicit clients (or clients prostitutes) in public outside the Zone of Tolerance.  (E-mails, telephone calls, etc. do not constitute solicitation in public.  Nor does meeting a person in public place.)  Also some people--minors, those who are intoxicated, etc.--cannot legally consent to engage in prostitution.

Many guys on the board fail to understand that in Tijuana there is one set of rules for mongers, a different set for prostitutes, and yet another set for those making money off the earnings of a prostitute. So let me repeat:

Prostitution per se is legal in Tijuana. This means a monger found with a chica without a health card and/or a monger found in a brothel has not committed a crime. A chica with a health card can work anywhere in the city as long as she isn't soliciting clients in public outside the Zone of Tolerance. A chica working without a health card is guilty of violating the administrative (health and safety) code, whereas the owner/operator of a brothel is guilty of a felony.

Once again: a monger engaging in prostitution anywhere in Tijuana is not guilty of any illegal conduct as long as he did not solicit the services of a prostitute in a public place outside of the Zone of Tolerance or engage the services of somebody--such as a minor, intoxicated person, etc.-- who cannot lawfully consent to engage in prostitution.

I think we've been through this.  I know that some guy who knew a guy who supposedly knows a lawyer told you that prostitution is legal in Mexico, but it isn't.  You can be arrested for it and you can potentially do time for it.

Normally, for just simple prostitution for someone who engages in it with someone over the age of 18, who is sober, not in danger, and not in financial constraints, the fine is about $150-$250 USD and/or up to 36 hours in jail. That being said, if they really wanted to nail you, they could incorporate the laws about you receiving monetary or other forms of compensation from an illegal act and really send you up the river.  This is why when the Mexican women say "I do not charge, I accept donations" this is utter bullshit because the law even specifically states that changing the language has no effect on the penalty and the view of it being prostitution.

I personally have never seen that happen where they throw the book at someone, but I imagine it is possible if they had an axe to grind or if you pissed them off.  I have however seen people in jail for the crime of soliciting a prostitute with the prostitute in another nearby cell.

I don't know what the word monger means in this sense, but I am glad to see you're coming around.  First it was legal throughout the entire city, and now it's legal in Zona Norte but nowhere else.

Like I said previously, go to the Ministerio Publico and ask them.  They won't get you in trouble for asking.  They'll tell you flat out that it's very illegal.

As I said, prostitution per se is legal in Tijuan.  That's why you've never seen somebody in jail for prostitution.

As I also said, there are laws governing the "the business of prostitution."  One of those is that public solicitation is illegal.

I now see why you don't understand the law: your source are cops--not lawyers.  Do yourself a favor, consult an attorney, and have him read you to law.

I did.  One of the three attorneys I've discussed this with is a former Mexican Federal prosecutor.  IMHO he's a far better source than cops who (1) haven't passed the bar and (2) probably only have a high school education.

I have seen people in jail for prostitution.  Both for the practice and the solicitation.  Prostitution is illegal in Mexico.  Period.  There are arrangements and understandings where the laws are not always enforced in certain areas, but this does not mean that those laws are never enforced and are not on the books.

I don't need to do myself a favor.  I know the law.  Been briefed time and time again.  And what are you saying the bar, and high school education?  Sounds like you're confusing yankee land with Mexico.  They are quite different.

I'm sorry, but your word holds no weight.  Your previous analogy compared a prostitute to a taco cart on the street.  Do you honestly think that the state police will send you to the juzgados and then the judge will say "Well, my gosh, he's right!  Prositution is legal.  Let the defendant go."

Give me a break, mate.  Sometimes I wonder what bloody planet you live on.

Oh and by the way, in order to be a detective for the state police, the education requirement is quite a bit more stringent than "high school" as you put it.  I think you're comparing the pickup truck city cops with state investigators.  Bad mistake to make.  Again, shows that you're not very familiar with the laws of Baja California and the laws and procedures of Mexico in general.  You're here for fun, I'm here for work.  We're going to have different frames of reference.
