...is to use private messaging between clients and providers.  For folks with TER or P411 accounts, you can communicate with one another through the sites' private messaging service and stay off the open email or phone calls for that matter.  In the case of TER, you can actually log in through https://www.theeroticreview.com (the secure SSL URL for TER) and your connection will be encrypted for your entire session, so you can talk about whatever you want to talk about while avoiding open communications susceptible to LE.  Same with P411.  Once you log in to P411 you're on an SSL secure connection and your interaction with the site is encrypted.  Even if LE has a warrant for lawful intercept, the communications are encrypted and are therefore useless.  

I've found that some ladies are much more inclined to discuss preferences and such through this kind of medium.  This has saved me the trouble and disappointment of setting up with a lady who does not offer a service I'm looking for, or has confirmed that in advance so there's no disappointment upon meeting.  Hope this is helpful.
