Anyone know anything about California rental laws?

...the 8th of February.  Some people who've paid January's rent would not pay the pro rated rent owed for only 8 days in Feb. and let the landlord deduct it from their security deposit.

Some may be afraid that the landlord would serve them with a Three Day Notice to Pay or Quit followed by an Unlawful Detainer (eviction case) but, practically speaking, if the landlord sees you're packing and getting ready to move, he won't waste his $ suing for eviction.

Landlords may also be unaware of the law that allows a 30 day notice to be given at any time of the month so you should be ready to cite the Civil Code Section covering it.

So my questions are, do you have to give your 30 day notice on the first?

Do you have to give it from 30 days from the date that you moved in?

I am month to month at this point and want to give my 30 day notice now which is neither of the above. Is that normal / legal? So lets say I gave my notice tomorrow the 8th, should't I just be able to move out on Feb 8th with Feb pro rated?

Thanks so much in advance!

XXX,

Natalie

"You can give the landlord notice any time during the rental period, but you must pay full rent during the period covered by the notice. For example, say you have a month-to-month rental agreement, and pay rent on the first day of each month. You could give notice any time during the month (for example, on the tenth). Then, you could leave 30 days later (on the tenth of the following month, or earlier if you chose to). But you would have to pay rent for the first 10 days of the next month whether you stay for those 10 days or move earlier"

If you have a written lease, what does the lease say?
