I am not a lawyer and have limited comprehension skills when it comes to legal talk.  I have done an exhaustive search on this site for "felony" and "misdemeanor: but still have not been able to answer my question.

Could somebody please respond with an answer in the simplest English.  I would greatly appreciate it.

I live in California.  I am a single individual.  What is the chances that I could be charged with a felony for any of the following"  A felony would really suck for me.  Also if you could give me the possible range of punishments for each that would be awesome as well.

Soliciting a massage with a hand job at the end
Receiving a hand job
Soliciting a blow job or intercourse from an escort
Being caught receiving a blow job or during intercourse

All of the crimes that you listed are misdemeanors.  The maximum penalty for a misdemeanor is one year in the county jail.  Depending on what county you are in, you may be able to have alternatives to jail such as house arrest and community serivce (among others). There are also possible fine, usually up to $1,000.00 and aids testing and awareness classes.

Here's your answer, and I hope it gets posted--because a lot of the writings I provide are never put on the board.

In California, all of the acts you've noted fall under two subdivisions of The California Penal Code: First, 647(a)- Lewd and Lascivious acts - and second, 647(b)- Solicitation. You can look these up for yourself under the California Penal Code.

Both offenses are misdemeanors and carry a maximum sentence of six months in jail and/or a $1000 dollar fine. All misdemeanors in the Penal Code for which a penalty is not expressly stated carry a six month maximum.

A vioaltion of 647(a) is a lesser offense than a vioaltion of 647(b), since a second conviction of the latter requires mandatory jail time.

Upon a first conviction of either, the defendant will most likely be fined, put on probation, and be required to complete HIV testing and education, however there are other penalities which can also be imposed like the suspension of your privlage to drive.

Familiarize yourself with these sections of the law, and make sure you understand what they say--knowlede in this area is indispensable. I hope that you find this helpful.

What if you received a hand job during a massage.  That's a lewd act from the masseusse, not the massagee.  Isn't the massagee being raped (except with consent)?

I think arguing that it's the escort fault if one's cock is in the wrong place will go nowhere.  What about the massage argument, though?  Of course, they could cause trouble for you simply by arrest and making you hire a lawyer.
