My biggest fear is when leaving an AMP or a hotel that I'll be stopped by LE and questioned.

What should I say to the cops if they approach me and want to talk about what happened?

Should I refuse to talk until I speak to an attorney?   Should I say that I went for a massage and that is all that happened?  Should I spill the beans since the odds are likely that they are going after the AMP or EMP..

I am married and for obvious wouldn't want my wife to find out.  However I figure that if I'm approached by the cops in that situation I am busted and toast on the marriage front.

You will NEVER 'talk your way out' of a bust.  Either they have something on you, in which case you are going to jail or they don't.  So STFU and tell them:
1. You don't want to talk to them and you might remind them that you do not HAVE to explain why you are in any public place.  Provide an ID and say nothing else.  
2. If they are detaining you are not free to leave, you want a LAYWER.  If you are free to leave - LEAVE
3.  If they threaten to 'tell your wife/boss/whoever that they saw you here, ask them how they are going to feel when you sue them for doing it - and you can!

I'd love to hear from from our attorney buddies on this one... in some counties in GA, there are very liberal loitering ordinances.  So while STFU makes sense, I'm always afraid that if I do, then the recourse for them is to simply invoke loitering and haul me off... granted may not stick but certainly I don't want the aggravation.  And if you do say anything that isn't true, then your nailed for that... is there any surefire way to insure you drive off short of not being there in the first place.. lol

Ask the officer am I under arrest? If the answer is no you are free to go.  If they arrest you for loitering in GA just because you were walking out of an massage parlor or hotel, you may have a pretty good 4th amendment lawsuit. Most officers go ater the low hanging fruit in this situation.  If you are respectful and appear to know and understand your rights, they will let you walk.  There are plenty of folks that will gladly spill the beans and then they have an easy case.

I've been approached twice by LE cing out of a known motel and I merely asked if i was under arrest and they said no, but we would like to ask you a few questions.  I respectfully told them I do not wish to answer any questions and unless I am under arrest I am leaving to go home.  I then walked and did not get into my car since I did not want them to run my plates.

The sad fact of the matter is that many people sit in jail or have criminal records whereas if they invoked their right to remain silent, they would never have been charged.

I am a criminal defense attorney in Chicago.  Your best policy is to remain silent.  The police officers are going to charge you whether you speak or not.  If confronted by LE, say nothing other than demanding to speak with your attorney.  I hope this is helpful.  Remember-The fish that keeps its mouth shut doesn't get caught.

Loitering should not be a problem if you are briskly walking down the side walk.  It would be hard to charge, if the cop intercepted you & asked you to stop.  It might be threatened but I really doubt that a bogus charge like that would actually take place.  Being prepared is invalueable.  
Again you have to properly ID yourself.  Then STFU.  Get out of there.

I've always thought that if I was leaving a Massage place and got questioned by LE about prostitution in the place, I'd just say "I don't know if they're doing that or not, but I just got a massage" and that would keep me out of trouble. Would it? Or, does coming out of a "house of prostitution" apply to everyone seen going in or out of a place?
