lets say you have worked hard to settle your stupid sol charge as a provider,,there is no evidence,,just the cop lying in his lousy sting (wasted an entire setting me up and i didn't do anything),,,except meet for lunch.... so i got arrested,,,and they refuse to give me an acceptable offer...i live in vermont,,the arrest was in california...so i am like kiss my butt at this point,,tired of spending $$$$ so can they do anything to me?
Yes, they can add more charges. Failure to appear/fleeing prosecution are considered bad things. They're probably giving you a crappy offer because you're out of state. They figure you'll have to take it.
I'm afraid I don't have any advice about fighting it, other than investigating if you can file a false arrest case against them. If you really didn't do anything, then they shouldn't have arrested you in the first place.
i do have an attorney and just signed crappy papers,,,after 8 months and 10 grand later i had to give up,,yes i filed a claim against the city of orange,,they are pissed about that too. of course no evidence.. just a pervert cop lies
You ought to hire an out of state lawyer in California to handle it. I believe they can do the whole case without you present over the phone. A bench warrant means that you did not appear for trial and no lawyer showed for you in your place. It is an arrest right granted to finish the matter.
california law states if it is a 1)misdemeaner 2) no prior 3) and if you retain legal representation ..then out of state people ,,can have resolution during all phases of the case ,,but the stupid corrupt orange county judge has been threatening my attorney with warrants..... they are scum ..i get punnished for being a good citizen a facing this illegal arrest
original charge is dismissed, you may be charged with Failure To Appear (for your trial). Judges don't like being stood up in Court. They will issue a bench warrant for your arrest. This information may be placed into the NCIC, and the warrant info will be available nationwide.
Thus, if stopped for a traffic ticket in Vermont, the cop checking you out may find you are wanted in California. You could be arrested and held for return to California. Then it would be up to California to decide whether it wants to spend the $ to bring you back there to face relatively minor charges. Chances are they won't so you can sleep comfortably.
