Is it safe to use private mail here considering the mn issues going on?

TER's servers are in The Netherlands, so they should be immune to any attempts by US LE to obtain records from them.

Let's hope this is the case, anyways.

but it is not my view bc

1. if TER is asked to provide member info in connection with an ongoing criminal investigation I think and hope TER would comply;

2. there is a treaty that allows for the service of subpeonas in foreign countries that are signatories;

3.and you do not have to serve it in the foreign county anyway if you can serve it on someone in the US with right of control over those records.
