So I'm reading that article that was being posted a couple of weeks back about the rampant STD problems in the porno community.  Sounded like an AWFUL issue by the way.  But it got me thinking.  So, making porno is LEGAL in California or at least in the Valley here.  Something along the lines of: as long as the point of the paid sex is for PERFORMANCE to make a film only, and NOT pleasure, then it is legal?

So like I said, I start thinking to myself (this is where I get dangerous, ME, thinking...)  What if a provider sets up a video camera in the bedroom and tapes the whole thing.  They romp and stomp through everything they want, and then when it is all over, she boxes up the tape and hands it to the hobbyist!  Technically, what he paid for, was the tape they just made!  The sex wasn't for PLEASURE, it was just necessary to make the video for which he had paid!  

Why won't this work?  I can't imagine that porn people have to get some kind of license or anything, the article made a huge effort to point out they can't even come close to monitoring all the porn video making activity.  If that is so, there must not be much of a paper trail.  Hell, I've been involved in making a small independent film in the past.  I didn't see any damn license or anything to do that!  Even if there is, how hard can it be to get?  Have you SEEN most of the rocket scientists who make these things?

I sincerely look forward to femalelawyer and other's responses.  Maybe I'm onto something here ;)

From my small understanding of law, you need a film permit or license in order to call it a movie.  I think.

hey, i am positive,, there are very strict regulations,,about doing films,,for example you have to be able to proove  legal age 18  plus,, HIV testing via PCR,,so you are opening a can of worms getting into that..also i know they also require actors to consent they are performing at free will..etc... and certain locations require permits..etc.. if it is 2 consenting adults filming each other and it is not for commercial sale,,, basically,you are ok as long as it is not the LE  ..but if LE do a sting i  promise they will create a case out of nothing and  charge you with mutiple felonies  again i stress LE will create a case...they love to waste tax payers $$ having fun

You see the intent of the video would be for your pleasure.  They can see through the transaction and call it what it is, prostitution.  If you sell the video for money then you have another interest in making the video.  You probably do not need a permit in the privacy of your own home.  You have a right to privacy in your own home.  Although in LA they require a permit to film no matter what.  So it would definitely border on acceptability even if you did market it.

One couple in another state did husband-wife performances for couples for a fee and they were charged with prostitution, both of them.  That is definitely one case that leaves one in doubt about a lot of things.  After all what is wrong with live performances for money?  The premise was that the couple was teaching better sex to others and they were busted for prostitution.  After that it certainly leaves much doubt in my mind that there are any methods of getting around the law whenever there is sex and money for any purpose.  Of course the fellow represented himself and that probably was not wise.
