live in CT tempted by CL but aware of the LE push with this venue.

i have been told by several attorneys that if you simply ask if the provider is associated with LE and she answers she is not and actually is - you get the free pass...

the CL attraction is simply convenience...pipe dream or stay with the tried and inconveniently true...hopefull

First of all asking in advance if a prostitute is a cop is not "pre-screening".  Pre-screening, in the hobby, is when you submit personal information to a provider so that she can screen you and verify that you are who you say that you are. This is the best kind of woman to see as she is cautious and discreet.

What you are talking about is simply wishful thinking and your attorney friends should have their penises whacked for giving you stupid advice.
If you wind up in a room with LE you are going down town no matter what questions are asked or what answers are given.  The case may or may not hold up but that's irrelevant.  The damage is already done as far as your family, friends and business associates are concerned.

The best way to beat LE is not to wind up in the same room with them in the first place.

How could any LE undercover work ever succeed if that was true?

(still not a lawyer)

by the Court of Appeals and the U.S. Supreme Court allowed an arrest and subsequent conviction when an undercvover officer "misled" the intended object of the sting. I can't remember which Circuit it was in, but I know the Supreme Court denied Cert. and the District Court ruling was upheld.

The term "are you a Cop..." has as much validity as " ... what happens between consenting adults..." and meaning no disrespect to those lovely ladies who use that phrase, it does not hold up in a court of law if a Cop says "NO, I'm not a Cop" and then busts you. It is NOT considered entrapment according to The Supremes.

Like Mr. F, not an Attorney but I know the law. Safe Hobbying!!

attorney, unless it is done in the context of the attorney-client relationship, or answers on the Legal Corner board for that matter.

The law is simply too vast for even the most skilled attorney consistently to give correct answers off the top of his head. If he gives you the advice in the attorney-client relationship, however, you can more reasonably assume that he knows the answer and has performed legal research to make sure.

The "free pass" advice is simply dead wrong. With one exception, LE can lie to you in the context of an investigation. In the undercover sting context, LE can deny LE association without giving rise to any defense when they arrest you. As far as entrapment goes, predisposition always trumps inducement anyway.

The Supreme Court has left open the possibility that some forms of government inducement may be so outrageous as to violate the due process clause, a defense completely distinct from entrapment. But all attempts to mount this defense I’ve seen have been unsuccessful to date.
