The Court of Appeal for Ontario says it will release Monday on whether or not the laws that interfere with prostitution business will be upheld or struck down as unconstitutional.  
I look forward to the Court of Appeals Court ruling on Monday. If prostitution is completely legalized, it could send culture shockwave into United States. Look for the decision on Monday (March 26) by typing "Prostitution, Court, Ontario,  Appeals, Superior Court Justice Susan Himel, etc." into a search engine.

I am hoping the Ontario Court does the right thing and strike down the draconian provisions that are preventing women from legally engaging in this profession.  

But I doubt that is will have any effect on the legal situation South of the border.

The Court of Appeal for Ontario has struck down some of the country’s anti-prostitution laws saying they place unconstitutional restrictions on prostitutes’ ability to protect themselves.

The court decision means sex workers will be able to hire drivers, bodyguards and support staff and work indoors in organized brothels or “bawdy houses,” while “exploitation” by pimps remains illegal.

Openly soliciting customers on the street remains prohibited. The judges did not struck down the criminal statutes of criminalization for prostitution purposes.

so I'm guessing the status quo will remain as to how taxes are paid.

Good question on the zoning, though.  Canada cities have a little more distinctive zoning than US cities do - that is to say, there are fewer 'mixed use' neighborhoods - generally, you are either in a business district, or in a neighborhood.  So I'm not sure how that will be handled.

Although they won't publicly admit it, one would have to wonder now if they will zone those businesses in Canada so they will be in certain parts of the City, also I am wondering will those businesses be required to file there taxes on a quarterly basis?  There are going to be a lot of questions and uncharted territory that will be traversed because of this decision.

I would not be in a rush to book a vacation in the Great White North.
Opponents are reviewing their options.  
Give them a little time to figure out that the world will not come to an end because some gentlemen are paying for sexual services.

Dear Natasha:
I am just wondering can it because now you really have a full scale business in the next thirty days since there is no more penalty for living off of the avails so in a since they would now be considered small business owners and they can legally have deductions for expenses and for there assistants as well. So to a small extent they would be accountable on a small level for payroll taxes. If they have kids they can get deductions on that as well. Finally what is the public health system going to include now to say that they aren't infected since they would become a public health risk since it is legal.

Outcall has ALWAYS been legal in Canada as in most of the world.

The incall/Bawdy house restriction is from the 1800's.. late forget date .. I was too young :)

The cities could require licensing as in adult body rubs and restrict number.

But Crown will most certainly appeal and won't go into effect for 1 years.  Everything unclear until the Canadian Supreme Court Rules.

But we now have extensive opinion by two judges, Himel at the lower Court with huge briefs and long opinion and now 25,000 pages of briefs and a ruling by the Ontario Court of Appleals

The appeals decision on bawdy/incall was 5-0.  It was split 3-5 on street solicitation with the 3 dissenting IN FAVOR of tossing out the street solicitation part as did Judge Himel in original case that was appealed.

Many huge agencies in Canada and in most cities no living of avails issue since they only sell time not sex.

In Victoria big agencies have incalls on main street downtown and police could care less about bawdy and inspect only to see if properly licenses (about $100/yr).

But ruling only applies to Ontario and on hold for 12 months giving time for Supreme Court to review.  The Crown has 60 days to appeal.  Prime Minister is very strongly against any lifting of prostitution laws so almost certain to appeal.

Outcall of course never an issue since 100% legal as is private solicitation by phone, ads, etc just not in a public place like streets. bars etc.  This is similar to almost all the world except the U.S.

12 months of uncertainty.

But incalls already exist all over and rarely enforced in most cities.  Outcall 100% legal and great adult body rubs etc.

Full contact nude strip clubs was upheld as legal long ago by the Canadian Supreme Court as long as no "penetration". Huge clubs in Ontario, but the Alcohol commission in B.C. limts contact in B.C, which it has power to do under liquor licensing.  But Ontario no such concerns.

I spent a decade of traveling to Canada and enjoying the freedom and sexwork.

But I also know opponents of the ruling will be fired up over this, and looking for a reason to attempt to stop prostitution, one way or another.  A large number of yankee sex tourist may be the ammunition they need, to have the government to completely shut down the sex industry.

Nothing will be done with outcall since not the issue - always has been legal as in most of the world.

Bawdy house (incalls) not enforced in many cities now unless some "real" crime.   But in some cities they have cracked down (York, Edmonton etc)
