Arrested - now what?

I am friends with another mature provider (who wishes not to reveal herself since she is embarrassed).

She was caught in a sting in Huntsville, AL yesterday afternoon.

Here's what she's told me that happened:

She got a call from a guy who said he worked as a contractor for Redstone Arsenal  - which is a military base and she couldn't call the base to verify him.  She's seen a few gentlemen from Redstone Arsenal in the past, never had a problem with any of them.

She arrives at the hotel room, decent looking 30ish yr old guy answers and invites her in.

She kicks her shoes off and sits on the bed.  He sits down next to her and they talk - he asks
"do you speak greek"
"no never learned the language"
"What do you do"
"I'm a giver"
"Oh really"
"I like to service those who serve"

really vague answers.   He then walks over to the table and asks how much was the donation, she tells him $200  - he asks about extra time, she says $50 for another hr.  He asks if she has change for $100 and she says no (she doesn't carry that much cash around with her).

He lays the money on the table, she is still seated on the bed.   He takes his shirt and pants off, she takes her top off, unfastens her bra, and sees him standing there in his boxers, putting his shirt back on.  She immediately refastens her bra and puts her shirt back on, just as the guy says he's a cop and four police enter the room to arrest her.

She has never been arrested before - only escorting part time to help make ends meet, its def not something she plans on doing as a career.   (She's college educated and 40 yrs old).

Police tried to get her to tell them how often she does it, how much money she usually makes in a day and so forth - she either gave really vague responses or didn't answer their questions.  (she kept her mouth shut).

At the station the officer that arrested her told her she should just plead guilty  at the arraingment on Monday and they'd give her a fine and that would be that.  She asked about it being on her record and affecting her future by coming up in any background checks, the officer told her it wouldn't show up because its a misdeameanor.

She was finger printed and as she was being put in a cell, got called back to the booking room because the officer changed the arrest report and changed the charge - originally it was "promoting prostitution" and he changed it to "soliciting prostituion"  - she doesn't know what the difference is or why the officer decided to change it.

She bonded out (after embarrassing phone calls to family) and has arraignment on Monday where she plans on pleading not guilty.

and that is to never ever skip screening.

When LE learns what the weak spot is (like working at that base), then that's what they use to lure you in.

Also learn from her example and never give LE any information at all, and NEVER believe a word they say.

They just want to get you busted, and aren't interested in your welfare.  That's what your lawyer is for.

(still not a lawyer)

I think you have picked up enough info on your friends coming of age partying, but let me comment on the vice cop who busted your friend  and was so ass-fixiated with anal, i.e. in “Greek.”  Previous to 1975 in the Alabama Crim Code, anal sex or sodomy was punishable by up to 10 years in jail. When the criminal code was rewritten in 1977, sodomy was re-classified as sexual misconduct with up to a one-year sentence. This law has not changed and still remains on the books and is the reason most of us refuse to have anal in Alabama although it is a good example of alliteration and would make a lovely chorus for a country western song.

For example, “Ass for you my anal Alabama copper,
                         Ask not what Greek I speak
                       Let me spread my cheeks sweet,
                         And you can serve as my copper stopper!

( sung to the tune of “Smokey da Bare” with two fart harmony)

    Non-the less, taking it in the ass or giving it to the ass is presently is a misdemeanor. One would think with the history of homophobic criminal law in Alabama, that it was aimed at curbing homosexual anal-izing; but in deference to the old boys who like it “Deliverance style” the new code makes an exception for married couples and encourages that back door shenanigans are relegated to spouses. Which reminds me my wife is calling....

the arraignment was today, she pleaded not guilty and was given a June 10th court date.

She is supposed to return to her former job in PA on June 5th.   She says she is going to see if she can get a lawyer to file papers to dismiss the case, but if she can't she just might not bother coming back to Ala to go to court.

If she does that - will it mess her up?  Like if she gets stopped for a traffic ticket, will a warrant for a misdeamenor in ALa show up and the PA cop arrest her and send her back?  Is that something she would need to worry about or would she be ok as long as she stayed out of Ala?

To answer your question, in general states cooperate on felony extradition, but that is not to say a misdemeanor charge will not be accommodated. When a person fails to appear in court, an FTA, failure to appear warrant is issued. This warrant does not specify the underlying crime; it is a separate charge and a separate crime. You can be arrested on the FTA warrant and held until the requesting state extradites or fails to extradite you. Meanwhile you may have to sit in jail over a weekend or longer.

If you do not clean up this warrant, sometimes an attorney can do it without your appearance, then when ever you are stopped for a minor traffic offense, when the policeman checks his computer he may find an interstate warrant and take you into custody, sometimes for several days until the state that issued the warrant decides to come and get you. It can lead to a lot of problems and computers have long memories. I recall years back we got a client off on a big criminal charge only to see him extradited to Florida for an old speeding ticket at the conclusion of his trial.

She should not leave this open...  get a continuance if necessary.   Leaving it open...  and record keeping is getting better...  could turn a vacation traffic stop into a nightmare.

they ask for anal because you say yes or no and you're screwed (or so they will try to convince you).

they will say, "well since you said no to anal, that means you are willing to have regular sex"

um no it doesnt, but I know of one girl who believed them and pleaded guilty to avoid "stiffer penalties".

no no no ...  saying no does not imply that you are agreeing to something else.
you must AGREE to something to break the prostitution law.
you agree by verbally saying yes, or it can be argued that nodding your head, or just smiling might constitute an agreement but NEVER does the word "NO" consitute any agreement.

if you always say "no" .... you do not break the law.
dont trust any attorney that tells you to plead guilty.

just keep saying no, and you'll hear "case dismissed" eventually.

been there, done it 4 times and every time, my attorney told me (sometimes screamed at me) to take the deal.
I said no, no, no, kept going to my hearings, showed up for trial and charges dismissed. 4 times.
it's all bullshit. .. they got NOTHING if they don't have an agreement.
i wont agree to do anything, i wont even agree to cuddle or hold hands.
if you have to ask, the answer is no.

fuck the bullshit, i'm not trying to be a criminal, just trying to have some fun and i REFUSE to allow anyone to put a criminal tag on me.  tent city has bugs

Just like my mom says "Detectives are just as bad as the scum bags they arrest." They will lie to you and tell you anything to get you to open your mouth. Just keep it shut and do not believe a word they say.
