At one time I was doing a little lay study on the constitution and laws that are legislated into existence and I though I learned that even though a law has been legislated it is not final for 7 years.
I think I understood that we the people have 7 years to ?protest? the law. Or appeal it.
what I am thinking is that many laws all are around that we can ban together and object to.
If escort sites are made illegal all of us can appeal the law.
Ok so I am not preenting this very well but someone out there knows what I am talking about.
could you whomever you are shed some light on this?
and if I am right I wish we all would start trying to get some of our rights back
A bill becomes law and enforceable once the Executive Branch [President or Governor] signs it. The Legislature sometimes will draft the bill with language stating it goes into effect at a future time (i.e. in sixty days). Seldom would the legislature request that a law take effect seven years later.
Would he be talking about sunshine legislation? Yes, laws are laws when executed, however, some come up for consideration by the legislative body and can be modified or stuck in limbo like "fast-track authority" or renewed like the Patriot Act...
Good thought, jinnimixxx. I thought that too upon reading the time specified as seven years. Yeah, many so-called "sunset" provisions cause laws to last only five or seven years before losing effect if not renewed by legislative action.
[Incidentally, I think they're called "sunset," not "sunshine," provisions which expire at the "sunset" of the legislatively-enacted period. "Sunshine" laws typically refer to the right of the media and public to attend legislative meetings rather than they be closed to the public behind closed doors. I knew what you meant though.]
However, sunset provisions typically mean the law goes OUT of effect and fizzles out. The OP is saying he thought the "law" starts as "out" and ineffective until seven years kicks in...sort of the opposite of what we consider to be a sunset law. Maybe a "sunrise" law? lol.
I think summer's come early to the Sunshine State LOL..Thanks for the nice correction..Although, I think in FL we do have legislation (not sure if that equals laws) regarding certain industries/professions that "sunshine" or maybe it is sunset? every 2 years...And the "sunshine" means that politicians can't discuss certain topics without the media/public present (no power lunches for special interests, um-hmm). I will look that up (and I know you're right, straycat19) just 'cause I gotta know.
But I still wonder how the original poster thought this could "help" the hobby...I mean, how much better can we be with more legislation on the topic. Seems to me, the support to legalize it is spotty, so if there were new, stricter laws enacted, (with public support-outspoken, surely to pressure the cong's to push it through the houses, state and/or federal) the support for would not likely be enough to change that once passed.
Can you imagine a rally of hobbyists/providers, LE would have a field day...
We'd all be wearing bandanas or skimasks and probably get labeled "terrorists" (of american values-LMAO)
Do you mean you were laying on the floor ("lying" would be the proper term....unless you were laying a woman) .... and perhaps dozing off?
If you paid any tuition for that "study", you were ripped off.
Laws that are of an emergency nature will take effect immediately upon signing by the President or Governor.
Can't tell you what the federal rule is, but in California "regular" laws after signing take effect on the following January 1.
Some laws, usually those that make significant and extensive changes to existing law may take effect between one and two years in the future in order to give attorneys and courts time to prepare for the changes.
Seven years in the future? Never heard of such a law.
ok then I will check out exactly what I am thinking of when I am done learning how to navigate the new sites I am on. What I remember is that we the people have several years to vote such laws away. I just want you to know that I did not post here to be troubled by folks that are going to be not nice. Please give me a break. I know I read that we can have 7 years to protest any law that is made. what I was thinking as it regards to this site is why are we leting them take our cars and lable us preditors. There has to be a way citizen can undo these laws. Were I a 'law abiding' wife I would not want my car/my husbands car taken and made police property because he saw a provider. I would not want my husband to be labeled a sexual predator because he saw providers. any way that is what I was thinking.
I don't know where you come up with this, but it is completely false. A law is final when it is finalized by whatever the procedure is in your state.
Most states make new laws by the legislature and signed by the governor. They may also have a way for the legislature override a veto by the governor. In my state a bill passed by the legislature that is not signed or vetoed by the governor becomes law without the governors signature.
But whatever the legal procedure its final and would take action by the legislature to revoke, or the courts can rule a law unconstitutional. If not you would have people who would be challenging the laws they don't like.
