Okay.. Here's how it went down. Saw a CL girl. Nothing mentioned on phone, 2 call system. wanted $$1/2 so I showed with over $$$ in wallet. Knocked on door, woman answered. Different girl but small head told me to stay. She asked what I wanted. I said "Just to kick back." She asked if I wanted anything else. I said I feel uncomfortable and "This isn't going to work." i turned to leave and LE popped out of closet. Said I petitioned for illegal activities. I said I never solicited anyone. They asked why I was there and I said I didn't want anything but to kick back. Escorting is legal as long as my expectations of the services are non-sexual. I said I never made reference to any such illegal activity. They said they did not care and booked me. They said by my simple presence coupled with having $$$ in my wallet, it was "implied." Can they do this?? (OK.. Let me say it another way...) Is this legal. I was leaving because the provider was asking too specific of questions.... Don't they need something else?
It depends upon where you are. What state honey? In CA they need an offer and an act. Showing up didn't used to be considered an act, but they may be getting convictions with it now.
Get a good lawyer with experience in these things. It's not that big a deal, and you will probably get it dismissed.
Please PM or e-mail me with the town and state or post it here.
Best,
TS Jamie
It was in the O.C.. California. I went to the arraignment and the bastards lied!! They said I put $$$ in envelope (which I didn't) they also said I asked for things I never did!! Don't they need recordings, or do they just make the sh*t up as they go?? I asked for a taping of the incident and my attorney told me they did not need one. Who's side is this guy on when he won't even ask for discoverable evidence? It cost me 3 G's just to retain him and I have another court hearing in 3 weeks. As far as reviewed provider... I took a chance believing that If I did not say anything explicit and promised myself to leave if it didn't "feel" right, I would. I followed my game plan and it still got me booked by lying OCSD. Why can't they just play fair. Why lie?? Thanks for letting me rant... ![]()
but don't be surprised if they, er, embellish it a bit by claiming that you said things you didn't, but the real damage is done; i.e. they created a fear of seeing providers.
You will need a good lawyer and like Jamie said, he'll probably get the charges dismissed, or have you plead "no contest" and have the charges expunged after a year or so, assuming you have no priors and don't get into trouble again.
This is probably going to cost you at least two G's before all is done as well as court costs. Also you'll probably have your name somewhere in the newspaper for nosey neighbors and your employer to see.
I assume this provider had no reviews?
Also, that they did not bother to screen you?
Let this be a lesson for all of us who think about short circuiting the usual precautions that allow us to avoid being put in this situation.
For the sake of others, where did this occur?
(still not a lawyer)
1.) Are you a VIP member of TER?
2.) Did you check to see if she had reviews?
3.) Did you google her phone number?
4.) Did you look for a posting history on CL?
5.) Did you post on your local board for info on her?
6.) Did you search CL for posts about her? Reviwes/Rants?
7.) Did you do your research or did you just jump at a pretty picture?
8.) Where are you located so others can be on the lookout in your locale?
Again, sorry for your trouble, but the answers to these questions can help others and maybe even you in the future. You are not the first to be busted, and you will not be the last, but lets help each other avoid what we can.
Thanks.
Getting caught is penalty enough...given the society we live in. Hopefuly if your arrest is not made public its good.
About your case from what you say is weak...but if you responded to an explicit ad then the case gets stronger.
(like mrfisher says "not a lawyer" )
Like said above, how explicit was the ad?? Many CL ads in themselves are already violating the law, and responding to them makes you culpable. Don't ever tell a chick you saw her ad. You got her number from a "friend". LE busted you because the could. They need numbers like salesmen need sales. Doesn't matter if the case gets dropped to them. Remember, they may lie and say you asked for a BJ or something.
I sympathize with your situation and I don't mean to be a jerk, but why the flock are you asking this question here? Are you going to go to the DA and say, "hey, my buddies on the escort review website told me that you can't prosecute me for this"? ![]()
There are very few things in the legal world that are carved in stone, no matter what people will tell you they "can or cannot do", and the only thing that matters in most courtrooms is whether or not my lawyer can beat up your lawyer.
Talk to a lawyer, friend.
man, pretty harsh!!
i don't know why i'm so nasty these days. i think i need to get laid ![]()
LOL. As someone else said here, cops will pretty much put whatever sounds good on the report. Hopefully, some recording exists of the "transaction." If not, someone else was correct in saying that cops will put tons of BS on an arrest report. As a side note, there's a reason both divorces and lawyers are so expensive: because they're worth it. I'm not a lawyer yet, but if you get in trouble in four months, call me.
