In most states the ancient laws barring fornication, rooted in prostitution originally and carried by religious zealots into colonial law to deal with unmarried copulators are caput. But in a number of states like Virginia they are still on the books. In reality they are never used or else the whole state of fuckers would be serious trouble. Excuse the language but you cannot have fornication without fucking. Anyway, here are the fees, though rarely invoked and laughable, for the state of Virginia. On the other hand, lascivious acts can be sanctioned and next time your girlfriend wants to give you a blow job in the bushes you might want to make sure the policeman gets his due as well or else prepare for a fine. Nobody likes to see you getting what they want to get so I would avoid exposition sex unless you are in a closed environment or the cop is butt fucking your gal while she is blowing you.

COV 18.2-11. Misdemeanors
The authorized punishments for conviction of a misdemeanor are:
1. For Class 1 misdemeanors, confinement in jail for up to twelve months and a fine of up to $2,500, either or both.
2. For Class 2 misdemeanors, confinement in jail for up to six months and a fine of up to $1,000, either or both.
3. For Class 3 misdemeanors, maximum fine of $500.
4. For Class 4 misdemeanors, maximum fine of $250.

Recently, after leaving a restaurant and walking to the parking lot, the lady I was with that evening got a little frisky, and we were engaged in kissing and some caressing. We got approached by a uniformed police officer, and told us to "stop what we were doing and move along". So I asked him if we were breaking any laws, and his reply was yes, and quoted some codes. The ones I remember I think are listed below.

My question is; Class 1 misdemeanor as it applies in VA, would it show on your record as minor violation, or as a sexual offense, and how about Class 3, 4.

I did some research, but still could not figure this out. Are these laws enforceable?


Relevant Codes:

Virginia Code § 18.2-344
Fornication

Any person, not being married, who voluntarily shall have sexual intercourse with any other person, shall be guilty of fornication, punishable as a Class 4 misdemeanor.

Virginia Code § 18.2-345
Lewd and lascivious cohabitation

If any persons, not married to each other, lewdly and lasciviously associate and cohabit together, or, whether married or not, be guilty of open and gross lewdness and lasciviousness, each of them shall be guilty of a Class 3 misdemeanor; and upon a repetition of the offense, and conviction thereof, each of them shall be guilty of a Class 1 misdemeanor.

I'm guessing that if you do it in the privacy of your own home, that the so called constitutional "right to privacy" would apply.

The next big hurdle would be to get a jury to convict you (jury nullification).

Now, if you are "caressing" in the middle of the street, all bets are off, even if you are married.
