Just taking money from someone that he knows is a prostitute does not establish pimping, at least in California. Pimping (or pandering) requires that the defendant cause or persuade the other person to become a prostitute, and that the persuading be accomplished by promises, threats, or something else.

In other words, the pimp has to be causing the person to be a prostitute. Just accepting money from one is not enough.

No. Just receiving money from a person that you know is a prostitute is not sufficient to make one a pimp.  Pimping requires that you entice or encourages the other person into being a prostitute.  California Penal Code section 266i is pretty typical.

It make sense in that imagine someone has a friend that he knows is a prostitute, and she gives him a gift.  He has recieved the "fruits" of her illegal activity.  She may even give him cash for his birthday.  He hasn't become a pimp.

Interestingly, in California under the elements listed, pimping does not even require that the pimp accept money.  only that he causes the woman to prostitute herself.
