I'm 99% sure I know the answer to this but figured I'd ask anyway.  Recently during a date with one of the local agencies in my area the lady I was with said "You can't be arrested for this as long as there is no mention of sex.  You're paying me for my time, not services.  You might be taking me out to dinner, or to a movie or to a special event so as long as we don't discuss money or what you expect might happen between us there's nothing you can be arrested for."

On the surface this sounds like common sense; however, I think the young lady has been misled.  The situation that exists would seem to point towards what's going on and I would think that would be enough?

Thoughts?

But what matters most is whether or not one of you is LE.  Unless LE has taken to bugging hotel rooms (Probably illegal but who knows in this day and age.), then you two can discuss and practice sex for money and no one is going to go down (in the bad way).

On the other hand, if one of you is LE, then your screwed (again...).

So, the trick is to avoid meeting LE, and that means see well reviewed provider (for the client), and do thorough screening (for the provider.)

If you find yourself with a gal whom you don't know that much about, and she is attempting to get you to say that you are there to have sex for money; head for the door and say that you have come to the wrong place.  It might just work, but don't get your hopes up.

Same goes for a gal who finds a would be client saying similiar things.

As long as there are just the two of you, "what me worry", but if the two of you are in a motel (common bust area) and there comes a knock at the door you will be at the mercy of Mr. Fuzz.

Read back a bit in the Legal Corner and you will see that the "theory of sex between consenting adults" and "pay for companionship doctrine" have been thrown out of the courts. Escort after escort reciting that mantra have ended up busted and convicted. Time to move on and face up to reality.

If you don't like the laws then get active in changing them. Humans, like most prize breeding animals, deserve financial compensation for sex. I paid a man with a dog three hundred dollars to have sex with my bitch. No one busted us.

Sex for cash is a fair exchange in my eyes. I have never turned down a beautiful woman with a hand full of hundred dollar bills who requested my services,  nor have I ever turned down a beautiful woman without a hand full of dollar bills, nor have I turned down ugly woman with no money. In fact I think I am going to advocate prostitution without the exchange of money. How about charging ten kisses, or a basket of roses? Oh no, they seem to doing that already and they still get busted......wanna buy a puppy?

A lot depends on individual state statutes.  Some require escorts to be licenced.  (Masseuses, likewise.)  Arrests can be made for these misdemeanor violations as well.  
Skipping over all that, prostitution is "sex for money" & is a violation.  "Soliciting for P" is a violation.  In most jurisdictions, P is a misdemeanor...  & often must be witnessed by a LEO unless someone confesses.   Does this mean you can not be arrested?  Assuming an arresting officer is 100% truthful, yes.   However, LE is very good at extracting the necessary statements for an arrest.   I would not count on a LEO officer's hearing or memory in these matters.  The only real protection is to not be in the same room with LE.

Funny fact:

You meet a girl and walk in her door. You say "here's your donation" you lay it on the table then walk out through the door. You get 2 steps out he door and you turn around and come back in and then proceed to fuck her senseless...illegal?? nope. Prostitution becomes prostitution when sex and money are handled in the SAME meeting/instance.
I mean how many chick sleep with guys from bars who bought them 4shots. Isn't that the same thing as what I do, only they fucked him for alcohol,not cash.

Rule of thumb. If sex and money are ever talked about in the same sentence then it's illegal. Also if money is exchanged and sex proceeds then it's illegal. Agency escorts can get away with this by a client pay the agency before the meeting to take her out to dinner. They go to dinner, and then back to the bedroom in the same night. A lawyer can have a field day with this as money was exchanged PRIOR to meeting and sex was never discussed(presumably) and the money was for her time at dinner.

So if you greet a woman at the door. Hand her the donation, then strip her and have sex with her(20 min later for example) that is illegal. See where the line gets a little blurry?! I mean sugardaddy/sugarbaby relationships are VERY legal for example...

I should have been a lawyer, but sadly I dislike the narrow mind justice system and all the white,rich, jerks who work in it.

I always thought that if the lady's pictures don't show bare breasts, vagina, or ass, then stay away. Only exception in my mind is if the aforemention lady has been reviewed frequest reviewers'

My impression is that you really believe what you wrote, but let me assure you there is nothing factual at all in your conclusions.  Nearly every related law concerning your topic uses intent as well as action as a basis for an arrest/trial.  But in the end, it's the jury or your own plea bargain that dictates the outcome.  Try convincing a jury that the hundreds of bucks you just gave up wasn't done with an expectation that you would have to let some guy soak his dick in your mouth, ass, or puss.  And, btw, in your mention of the agency scenario, the only thing that does is add conspiracy to the list of potential charges that could be levied.

pwilly-I actually talked to a lawyer about this in my home state...So unless he got the law wrong....
Keep in mind each state is different...but the fact is if money and sex are exchanged in the same scenario then it is prostitution,plain and simple.

Oh yes, I completely agree.  It's those cases where it may not be discussed in same sentence that I was challenging.  Even if it is not discussed in same sentence, it can still be considered soliciting by LE, such as paying an agency but not the actual girl, dropping a donation in a room then leaving for a few minutes only to return for a romp, etc...  Some may think LE got it wrong, but once they make the arrest, you have few options because a jury isn't going to be easily convinced that your intentions were any but ....

Honey, we are in the same general area and you are very naive. It's not as safe around here as you think. There is a very active vice squad in an upscale area that one might assume is safe.
