There are always lots of questions about how and why hobbying is different in Canada than it is in the US. A client sent this nicely written, brief overview to me, and I thought I would share. I'd credit it if I knew who wrote it.
Outcall sexual services of an independent ESCORT / SERVCIE PROVIDER is absolutely legal in all of Canada under the long-established Federal Law /Criminal Code since at least the mid 1800s. Canada is the land of the sexually free!
It's perfectly legal for an ESCORT / SERVCIE PROVIDER to see a client in a hotel room, or the client's home or other personal space.
It's also legal for an ESCORT / SERVCIE PROVIDER to advertise in magazines and newspapers, Magazines and newspapers are not considered public so sex trade workers can legally advertise in the press.
There is no need for a customer to use euphemisms or codes when speaking to a ESCORT / SERVCIE PROVIDER over a "LANDLINE" (phone).
The Canadian Supreme court has ruled that a land based telephone is a private communication.
"But most ladies use cell phones."
An "INDEPENDENT" outcall ESCORT / SERVCIE PROVIDER has the right to discuss specific acts of sex for money in private, IE: Hotel rooms, land line telephones and private homes.
What is illegal in Canada:
It is an offense to: a) "Keep" a brothel b) Work in a brothel. c) Be found in a brothel d) Rent or lease space to someone who plans to use the space as a brothel.
- SECTION 210, the Criminal Code
So no incall
It is an offense to knowingly take, offer to take, or direct someone to a brothel. - SECTION 211, the Criminal Code
This law makes it an offense to solicit or "communicate" for the purpose of companionship in a public place. SECTION 213, the Criminal Code
While escorting itself is legal how it is practiced is restricted and enforcement differs greatly in different cities across Canada.
Windsor, Barrie and a few other Canadian cities REQUIRES all ESCORTs / SERVCIE PROVIDERs to have a valid ESCORT LICENCE to work in the city limits.
You might also be charged for solicitation & running a brothel if you offer incall. Again, this varies by city. In Toronto, this law is rarely enforced, unless the brothel is employing under age girls or illegal immigrants.
Brothels are normally allowed to operate unless the neighbours complain. Police are more interested in keeping the street corners hooker-free and busting MP's. There is little interest in busting outcall agencies or incall places which are respectfully and responsibly run.
The police are not that efficient and the cop man-hours required to bust an incall joint are not cost-effective in dealing with a problem they consider very low priority.
