Is Massachusetts a death penalty state??? I cringe to think that the anwser is no, seeing as its a pretty liberal state.

Although it rarely happens, the only way of getting a death penalty in MA is if you are tried and convicted of a Federal offense.

I am not a lawyer, nor do I play one on TV, but I would guess that it will not be pursued in the CL case.

we DO have a great bunch of guys in our prison system who will be more than happy to rape and beat our little friend Phillip over and over again for the rest of his life. Not the "death penalty" per say but I'm ok with it. He'll wish he was dead.

I doubt it would pass. Blaming "the system" is a talk radio rationale. More states recently have been halting the death penalty after DNA has freed so many convicted people.
I'd probably vote for it, though.
