abuse of power, according to the Court of Appeals in a decision released today.
Three Republican judges – including a Rick Perry crony – affirmed the ruling of the Republican trial judge and rejected all 16 challenges to the abuse of power indictment.
T he court did strike the indictment of Perry for coercion of a public official saying Perry’s threats to the DA were protected by the First Amendment. The Perry spin team immediately tried to portray the decision as a “victory,” claiming that the remaining indictment is just a misdemeanor. Um…no. The abuse of power charge is a felony and carries a maximum 99 year sentence; the indictment struck, however, provided a maximum 10 years imprisonment.
So the really critical charge is going forward. But according to the spin team, the remaining indictment “will have no impact whatsoever on the campaign.” Um …no. The Romney bundlers – the key undeclared financiers – are not going to give this guy money now. Even worse, Perry has already spent 2 million in legal fees; his campaign has only raised 1 million, according to ABC. Ouch.
Of course, both sides can appeal to the highest appellate court for criminal matters. But, if Perry does that, he delays the case for another year and in the interim will never raise the money needed to keep his campaign going. His only chance was to get both indictments tossed before the debates start.
Did one of the Board righties tell us last August that the case was “already over”?
Did another righty insist that the indictment was “all political”? This just a guess on my part, but it sure looks like you guys were um…wrong?
Could Perry actually go to jail for this? It can reach 130 degrees in Texas prisons in the summer and they don’t have air conditioning. Ironically, Governor Perry was willing to spend much money to install air conditioning for the prison swine population but not for the prisoners. Bad decision? you make the call.
We will have to see what the evidence is but, as predicted last summer, his presidential campaign is now on life support.

The other thing that Mari so conveniently left out is that this is the last charge Perry still has to face. While Mari is out there thumping his chest that a single charge still remains, the Perry camp is celebrating "one down and one to go"
I haven't heard a single word about Perry dropping out and when he does finally drop out and quits embarrassing Texas on the national stage it won't be because of these charges that will never stick. It will be because the entire nation will see Perry for the scumsucking liar and phony that he is. He actually reminds me of Hillary in one respect, the very sound of his voice tends to put me in a worse mood than I was before hearing it.
Yes, Perry is going down, but not over this bullshit, and Mari is wise to keep ducking out on my proposed bet. Too bad he won't ever read this, seeing how he and bird brain have me on ignore.

Even if he appeals again and wins, that decision will come too late for him to reinstate his candidacy.
As to Perry being a man of integrity, how can you conclude that now? Until the prosecutor presents the evidence that convinced the grand jury to indict, how can you conclude that he is a man of integrity? You don’t know what the witnesses said.
The media and the clueless righties have accepted Perry’s explanation that he vetoed funding for the public integrity unit bc he had no confidence in the DA. But this veto had no effect on her at all. She is still the DA at full salary. She did not run the public integrity unit herself; that was done by career professionals in the DA office. But he did stop the investigation into his no bid contracts. Plus Perry offered her continued employment in the DA office if she would step down. So he had no confidence in her having the top position but she was still qualified to prosecute cases?
Aren’t you at least suspicious of that? Not politics here Dude- if the grand jury was correct, this is potential criminal activity

You seem to think “the Left” is behind the indictment. Fine, tell me where.
The original criminal complaint was indeed filed by a public interest group. Let’s call them a leftist group.
After that? Nada. The complaint was considered by a Republican Judge who could have dismissed it. Instead, he asked a second Republican Judge to review it. The second Republican judge determined the allegations had sufficient weight to be reviewed by a prosecutor. Did he pick a Democratic DA from Travis County? No.
He assigned a special prosecutor to the case who had no partisan leanings. That guy reviewed the allegations and investigated the case. He concluded the evidence should be presented to a grand jury. We don’t know the political leanings of the various grand jury members – that is not disclosed in the selection process. I suspect there were both Republicans and Democrats on the grand jury. But the members of the grand jury were picked by the Republican judge.
The case was assigned to a Republican trial judge. He twice denied the motions to dismiss. The case was appealed to three Republican appellate judges who concluded Perry has to go to trial.
So, my friend, after the filing of initial complaint, where did “the Left” have any effect on the subsequent proceedings at all? Perry is going to trial bc Republican judges, a non-partisan special prosecutor, and diverse citizen members of the grand jury all concluded that a jury should hear the case.
As to "bring on the evidence" I am glad to hear you say that. Perry disagrees. He haas fought like a tiger to have the indictments dismissed before any evidence can be presented. He could have done the same appeals after the trial- but so far at least he does not want the evidence to become public

User was right. I wanted to see it and it WAS there. What I saw was that Texas was NOT the world's 6th largest economy if it was a nation on its own. As of 2014, the Texas Comptroller of Public Accounts determined that Texas would be TWELFTH, NOT SIXTH, if it was a nation.
