you must be in northern california,,orange county won't budge no matter what ...they will go to trial with not a lick of evidence and win on lies,,and the stupid judge overturns not guilty,,jailtime first offence no crimnial history,,consider yourself very lucky
I went from solicitation charge down to disturbing the peace. All I had to do was go to health education class and take hiv test. My lawyer also had me go to a couple of therapist sessions to show I was taking care of the situation. The only thing that sucks is that I will never be able to get the arrest for solicitation of my record. I am worried about future employers looking and seeing that I was arrested for solicitation. I wish they would change my arrest to whatever I was convicted of. Arrested for disturbing the peace sounds better than prostitution.
I think I remeber someone saying that in Calif. your arrest record is for the last 7 years. Kind of like dmv points falling off after 3 years. Is this true, in seven years employers doing background checks will never see that I was arrested.
Its my understanding that if your attorney does his job well, then the "arrest record" should be changed as well. That is a very important part of the legal work.
After about a year, providing you've served your sentence--whether probation, a fine, time or whatever and in any combination the judge imposed, you can usually have your record expunged i.e., not available to the public. Your rap sheet--criminal record-- never is erased; it's always available to the cops, anywherre in the country.
after one year and I get my record expucheg what will potential employers find on a background check? I am being charged with disturbing the peace, but I was arrested for solicitation. Will employers see what I was arrested for or are they only able to find out what I was charged or sentenced with. This is important as I can explain disturbing the peace easier than solicitation. If there able to see what I was arrested for than am I able to seal arrest records? I heard that in calif. an arrest stays on your record for 7 years, is this true?

Don't blame the attorney. An arrest record is hard to delete from your criminal history unless you received diversion. Diversion, of course, is not offered on prostitution related offenses.
