Hacked a web site that is a public forum and left some message of public interest. Just as Sheldon A. Cannot stop protestors from protesting his no union policy in front of the venetian, even though he owns the sidewalk, a public forum web site would face the same objection if they refused say to allow the kkk to post but the kkk hacked them and posted anyway. Hacking private email or hacking without expression would not be protected.
What the government can Constitutionally do differs from what private citizens are bound by. So to start, protesters do trespass on private property sometimes, and generally they are subject to arrest and charges. So can they do that? Can you rob a bank? Yes in both cases. But you might get arrested and go to jail. Is that worth it? Maybe. Your call.
So the relevant question of privacy is like, if I look out at window at people walking down the street the same as someone looking through my window at me? Is a peeping Tom given the "right" to look into other people's homes because those people assume the right to look out of their window at people who are out in public? My opinion is no. A peeping Tom is in violation of rights of privacy if he looks through the window into a person's home, but the homeowner can look out the same window at people on the outside without violating their rights of privacy. Same with hacking into someone's computer.Any banning of FatVern by SCOTUS must be balanced by banning Taffy. FatVern at least provides humor -- even if unintentional by him. Taffy provides no humor at all, unless negative humor counts.
