Very complicated if it's 269-269.

There's a vote in the House of Representatives with each state getting one vote, so you have to get a majority of the 50 states.

Currently the Dems hold a 26-21 advantage in states (more Dem reps than Rep reps) with Arizona, Kansas, and Mississippi being split down the middle.

But the Democrats will probably pick up more seats this election meaning if it is a tie, Obama should win pretty easily.

But the new members  of Congress would not be involved in a tie breaking process on the election .

Constitutional experts are not in ageement on that new members are involved so you would see a huge lawsuit which will happen by Obama if he loses as close as Kerry .
