Could someone, possibly an attorney, post that misdemeanors very rarely go to trial?

The prosecution has a weak case; or the defendant cops a plea, which essentially gives the prosecutor a win, but not as "big" as it might have had if the case went to trial.  Someone charged with a gross misdemeanor might cop a plea to a misdemeanor, for example.  There's not a huge incentive for the prosecutor to go to trial, tho -- a conviction for a misdemeanor is small potatoes, and requires calling cops and other witnesses, so the resources expended are disproportionate to the result.  Defense attorneys usually ask for postponement after postponement to increase this cost and push for a plea bargain.  In some cases, the charges will get dismissed.

I'm not an attorney, nor do I play one on TV, but the trial question first depends upon the defendant's plea. If the plea is guilty (or no contest), the next step is sentencing. If the plea is not guilty, the defendant has the right to go to trial. Plea bargaining, however, is very common.

I was hoping for an attorney, there are two other options for a misdemeanor.

An Alford plea is where you admit that the prosecutor has enough evidence to proceed to trial, but you elect to take punishment of the court.  Typically this will allow for your record to be expunged at a later date.

The other is a continuance in lieu of dismissal.  You pay a financial fine, your case continued for a period of a year and if you do not re-offend, the charge is dismissed.  This is most applicable to traffic tickets.

Time and effort = money. However, certain lesser crimes have a newsworthy appeal that makes them easier to justify.

So no, misdemeanors rarely go to trial. Why spend $10,000+ on a trial for a $500 fine. However the defendant can press for a trial... which is risky, because pissing off the judge (if they believe the case is really solid against the defendant) will likely get them 90 days as well.

Obviously you know all about this, so why ask here?  If you want an attorney for fine-line advice, there are plenty out there.

Do you know how many people on this board have misdemeanors? Probably 50% for driving carelessly and other BS reasons. WTF.

When you get charged for a misdemeanor, you go to court and tell the judge how sorry you are. They give you a lenient sentence (therapy, classes, etc) for never having had issues in the past because it's not worth the time to spend on trial. No one gives a fuck, really!

Once you get a meaningless misdemeanor for something, you'll understand why there's no point in regularly posting on this board about HH's misdemeanor. It's like peanuts when it comes to real crime that courts pay attention to.

Perhaps if the threads didn't keep getting pulled, new ones wouldn't started again and again.  Perhaps if no one ties the OP's question to a specific provider, this thread might stay up.  And what is a misdemeanor now can become something else entirely later.  Regardless of what prompted the thread, interest in legal issues goes well beyond any specific person, provider or hobbyist, who gets arrested.

You all are spending more time focusing on a misdemeanor than the judge will. There's worse misdemeanors than prostituting that never go to trial. They just don't have the time or interest to spend money on something so minor.

I'd go for a hand release over a work release.
