I am writing to ask advice from anyone who happens to be a lawyer.  

This is the situation:

In 2012 and 2013 I saw a prominent escort here in DC who is still presently working and advertising on TER. Some of you will already have seen her. I will call her Ms. X. We became quiet close and after seeing her for a year I lent her my credit card in November of 2013 to pay for one night of a hotel for a friend of hers who was also an escort. Ms. X repaid me, but unfortunately her friend burned a pillow and the hotel charged me $150 for the loss. I wrote to her to get back the $150 but she did not reply.  
As I was having financial difficulties, I decided to write her again --- I know it has been 8 years, but I don't forget debts. I wrote her on November 22, 2020 and sent her the following email which I have translated into English from my Spanish: "As you will recall, you still owe me $150 for the pillow which your friend burned in the DC hotel and that I had to pay for with my credit card. You may pay me as you wish and everything will remain buried because I don't want any problems and you don't either. I hope you and your husband are well. Thank you."
To my great surprise, she replied with an email threatening to send the police to my home and take me to court for extortion and harassment (WTF?). I replied: "Ms. X, don't be silly. This has nothing to do with extortion and your threats are therefore meaningless. You may send me a money order. It is entirely your decision. I would advise you not to threaten me again. Thank you." She then blocked my emails.  

Naturally I decided to give up and take the $150 loss. But this morning (7/6/21) at 7 a.m. a police officer knocked on my door and gave me an order to appear in court because Ms. X served me with a Temporary Protection Order on November 23, 2020. My hearing is scheduled for July 19, 2021.

My question is this: I have never in my life had any problem with the law. Should I just meekly accept the Protection Order -- no problem, I have zero interest in ever seeing or writing to her again -- or should I produce the emails to demonstrate that I am not a crazy stalker? I would gladly call her out on her lies, but I do not want to put her at risk (nor her poor husband), nor do I want to expose myself to a fine for being a "john."  

I should add that Ms. X is very mentally unstable and has had two arrests, one for marijuana and another for assault.  

Can anyone give me some advice, please?

Credit companies let it go. You should have let it go since you didn't press the issue 8 years ago.  

Seems like a good case for a tv judge show though.  

 
Not a lawyer....But the way you worded the email was aggressive talking about not want problems and wishing her husband well like he could be harmed, lol.

but don’t be surprised if you receive a number of responses pillorying you on a number of bad choices you made here.  

I’m not going to pile on as I know you’re already beating yourself up for the choices you made, and I’m no lawyer, but I’d probably show up the hearing.  

1) The lady in question may not show up, and the whole thing may be dropped. She may have initiated this whole thing to scare you, or she may just decide it’s not worth it to as the hearing date comes closer.
2) If she shows up, then at least you get to tell your side of the story, and put it in the hands of the judge.  
3) If you don’t show up to tell your side of the story, the judge may approve the order against you, making it public record.  

Maybe an actual lawyer can give you some legal advice. Best of luck.

Thanks, I know I was stupid. I expect that she won’t  show up because a) she has no evidence and I on the other hand have the emails and b) she could be afraid that I would expose her as an escort. Btw it’s very interesting that she just withdrew all of her reviews on TER, although two exist of her from 7 years ago with her and someone else doing a double.

What you do depends on your situation.  Everyone is a little different.    
Single or married?  Profession?  what would your employer say if public?  Do you have a clearance? what's your tolerance to being outed or having a record of this on file?

I would talk to a lawyer to learn all your options and ramifications.

If 150.00 from 8 years ago still eats at you, you're in the wrong hobby.  This could have been handled sooooo many other ways. An extra 30min on the appointment is one way.

I would assume the legal authorities know nothing about the activities and only about the demand for repayment and the potentially threatening tone of the communications. No reasons to think that Mrs X has some incentive to go their either.  

 
You might want to find out just what the specific charges against you are and the specific penalties. Since you're going to court and somehow I don't think this is small claims court (but don't know) you probably want to have some legal representation. However, you might also just show up and confess you're confusion on the charges and see what the judge says. If he want to take to a conclusion that might cause significant fines or sentence ask for a rescheduling so you can get legal representation.

 
A quick googgle search gets me:
"A temporary protection order can be granted without notice to the adverse party. However, the court can require a hearing before deciding whether to grant a temporary order.

An extended protection order cannot be granted without notice to the adverse party and a hearing."

 
Based on that it sounds like the hearing might just be for the court to see if any such order should be issued.

This is not a matter of money. At this point I’m willing to suffer the loss. I just want HER to stop harassing ME! If she shows up for the (virtual) hearing she will have zero proof of harassment. I just hope the judge realizes she is lying and will make her pay court costs (if any). She would be wise to just not show up. I hope she is reading this!

If you want to play this game, you gotta get over small stuff like $150.00. Just chalk it up to a bad date than trying to collect something that you think was owed to you 8 yrs ago.. horrible situation, dunno if 150$ would be worth that headache. Reasons like this is why I rather not share hotels with anyone. If something happens is my responsibility.  

Oh the other hand, we all went thru a lot of complications last year, I had have people that I lend money to but I just not gonna email someone asking for that amount of money.  

Hope this situation resolved.

Even if the judge denies her petition, your name will show up in the MARYLAND Case Search as being the subject of a denied protection order. It will stay there for at least two years until you petition to have it stricken from the record.

If you don’t show up, the likelihood of the protection order being granted rises exponentially.

If you show up without a lawyer, the odds that the protection order is granted increases.

And if she’s reading this, she’s probably printing out your comments and providing them to the court. I would stop posting and keep your correspondence on this topic restricted to a) your lawyer and/or b) DM’s to people here you’re discussing it with.

Wishing you luck on this, but know that without a lawyer representing you, your court day is probably not going to be a good one…

Long before you were summoned to appear at the hearing, the petitioner (Miss X) had to provide proof to a court commissioner that she felt threatened by you.  The only thing the court is going to determine is whether there is enough proof to establish that you are a danger to her that requires court intervention. If there was “no proof”, the commissioner wouldn’t have granted her a hearing before a judge.

She’s not lying. You admitted that your email trying to collect an alleged decade old debt included a reference to her husband. And then you repeated it here.  Given your track record on this matter so far, you REALLY need to hire a lawyer.

Alleged victims don’t get charged court costs for seeking a protective order. Not a good look from the judge’s perspective, and it would be a barrier to poor folk seeking protection from abusers/stalkers/harassers.  

You don’t seem to have a good grasp of the circumstances you’re about to be facing.

Some of the people on here sound stupid.  You don't need an attorney and there won't be any "charges"...

ANYONE can get a TRO against anyone else, and they don't have to show or prove much of anything.  The time to show and prove is at the hearing.

Hopefully you have your records...and the credit card receipt and the emails proving your case.  You show up...virtually...explain the situation...and the judge will likely not grant the actual restraining order...

UNLESS...you appear tot he judge as deranged as you appear to many of us.  Chasing someone over $150 8 years ago is fucking weird at any income level...much less the income level one would need to be a regular hobbyiest and be "loaning" providers money.

You were dumb to give her your credit card in the first place, and she was dumb to then let another provider use and damage the room...YOU should chalk it up to a $150 lesson...but you can absolutely defend yourself against a damn TRO...

Update: I knew I didn’t need an attorney so I checked in at my assigned time 8:30 am. They were about to dismiss the case when she appeared at 9:30 am. I was given the option of simply accepting not to either contact her or see her (which is a joke because I don’t even know where she lives) or request a trial. I was tempted to go to trial but I wasn’t going to pay for a lawyer so I gladly accepted the order for 2 years—-it also stated that I made absolutely no admission of guilt. I am very happy that she will now stop harassing me. She is very mentally unstable and you all would have laughed if you had seen some of the crazy statements she made, including one that “someone” (unidentified of course) had told her I had a firearm. Lol, I am totally anti-NRA and would never even touch a gun.🤣 Anyway, case closed. I will never lend money to an escort again.😀

Since there was no crime committed, it will not show up on a criminal background check. However, it is on public record and could be found if somebody were looking for it. I don't care at all, I'm retired.

It was interesting that he opened the thread saying the alleged victim had no chance in getting the order granted, and then he flips and tried to paint the order against him was a win because he wasn’t being criminally charged.

Rest assured, if he violates the judge’s restraining order, he will be criminally charged.

Thank you. He mentions it is interesting that her reviews have been removed from here too. She HAD to remove them to protect herself from this crazy stalker!! She was afraid he would bring it up in court. So she took everything down. She also has to change her name AGAIN to get away from him!  This is not the first time she has had to do this due to his constant harassment. He is crazy.
