"The district courts shall have original jurisdiction of any action in the nature of mandamus to compel an officer or employee of the United States or any agency thereof to perform a duty owed to the plaintiff."18 USC 4, misprision of a felony, is actually a crime at least - but it requires more than just failing to report a crime, it also requires some affirmative act to conceal the crime. Comey actually gave the memo to several people in the FBI and you would think the acting director would have seen it too if the memo is so important.

But a memo, is only a memo..It'll be a "He said, it said". trump will deny it, of course and that will be that. Now if there's a tape, then watch out. It's a "meh" moment as far as I can tell.

Contemporaneous notes are widely held up in court as credible evidence of conversations. Comey is more likely to be believed than Trump. The White House will have a record of who entered the Oval Office, who left it, and when. Also Sessions and Pence will have to testify about what Trump said when he asked them to leave. If it corroborates Comey's memo that makes it even more credible. Beyond the fact that Comey, whatever mistakes he made last year, has a record for ironclad probity.
