In New York, there is no thing as "no fault" divorce, but abandonment, which includes the refusal to give sex to the partner, is a ground.  (Yes, all you wags who say that they get no sex from their spouses have a ground for divorce).  In a recent case, there was a dispute between husband and wife as to whether they had had sex in the prior year.  The husband introduces evidence from his urologist that he was given a sample of 10 Viagra pills, and only 8 were left in the bottle.  The Court sees this as enough corroboration of his story that they had had sex to deny the divorce.

The wife foolishly testified that the husband had no other reason to take the Viagra.   Little did she know that he might be a member here, or have other extrcurricular interests.  LOL

How many people who are served with divorce papers really end up trying to fight legally to stay married?  The grounds for divorce are usually just a formality to comply with the law as written but the courts never really get into whose fault was it.
The most commonly used grounds for divorce is "constructive abandonment" which can include refusal to have sex.  All the other grounds are more difficult to use as they require a different threshold of evidence to apply.  Constructive abandonment can be established easily by both parties testifying to the fact that there has been no sex for one year and both parties were physically able, and there was no reasonable cause for one party to deny sex to the other.
