Justice Sandra Day O'Connor has just announced her retirement from the Supreme Court.  That means that it is likely that Ole Georgey-boy will most likely have two justices to nominate as Chief Justice William Rehnquist will likely not last through the term of the President.

The sad thing is that what happens with this president and his nominations will impact jurisprudence in this country for the next 20 years.

Wow 2, now I know we're screwed. I guess we can expect even more drama when it comes to hobbying, among other things.

Bush deserves to nominate judges that will respect individual rights and state's rights!  BTW, this belongs on the politics board!

Listen moron, the supreme court is already right wing/republican based.  The eminent domain "land grab" is a right wing based initiative.  Get a clue and learn your politics.

This is why O'Connor, Rehnquist, Scalia and Thomas dissented?? This is why DeLay is making noises about legislation to deny federal funds to localities that use eminent domain for economic development purposes??

country's founding. The only difference this time is that the High Court gave credence and cover for it, AND, set defined conditions under which it can take place. Given that the powerful and well connected have always had avenues for taking land from the less powerful and well connected, having definitions of when land can be taken does leave us better off than.
I read today that members of Congress are set to pass laws that reverse the Supreme Court's decision. I hope that a samrt Congressman or Congresswoman slip in a provision that allows people that have been victimized by eminent domain laws during the last, let's say 100 years, to seek restitution for their loss. My sharecropper great grandfather had land taken from him by the govenrment using eminent domain and walked away with no more than meal money. There was no process as I have been told, the situation was one where the powerful simply took the land because they could. Now, if laws are passed, given my fine education and social standing, you can bet I will be looking deeply through my family's archives for lawsuit material. I don't need or want the money. But proving a point is worth something, wouldn't you say?

Yet George Bush and many Repubicans repeatedly attempted to intervene and reverse the studied decisions of those courts. So respecting State's Rights depends upon which rights one is referring to.
I am all for respecting State's Rights, as long as the practice of doing so is balanced and the federal government only intervenes when states cannot or will not meet their obligations, as was the case for Jim Crowe laws in the South, or in the case of disputes between states.
