Hi all,

I need some legal help in the area of commercial leases.  It is a long story, but I am in the appeal (prevailing) process at the moment and my attorney has dropped the ball.

Anyone with any good names in this type of law, please do let me know.  PM or call.

Thanks.

Kim

You should look for a lawyer who practices alot of landlord tenant law.  Not a mill, who does $200 evictions, or simple tenant defenses for $1,000, but someone who has done hundreds of evictions and practices real estate litigation and appeals.
Many lawyers will try to charge you a lot for an appeal, when often they are very simple.  I assume when you posted you are in the appeal (prevailing) you are the respondent, good, that makes it a lot easier for you.

But watch the time tables, you have a set time to file a responding brief, an extension is possible (and almost always granted) but if you are in the appeallate department, those bastards are tough if you let your deadline expire without asking for an extension first.

Look in www.lawyers.com or www.findlaw.com

Good luck

I doubt you will find an appeals lawyer who has done (and continues to do) "undreds of evictions".  Eviction lawyers are frequently usiing that as a way to meet prospective clients.  (I do not handle evictions; never have.)

I agree you won't find a "certified appeals" lawyer who does hundreds of evictions, but you will find many real estate litigators, not mills who advertise $100 uncontested fees and $200 trials, who are competent to do an appeal.  The folks who do the UD mills are never in the office long enough to think or write a motion, let alone an appeal.  But, there are many nuances to eviction law that an experienced real estate litigator with real landlord tenant experience knows what to do.  Real estate law is one of the areas of law with exceptions to exceptions, and sometimes cases from 1880 are still good law and will win your case.
It seems our person who needs help is responding to the appeal which is also much easier then filing the appeal.

The other interesting UD issue is I still believe 70% of all ordinary evictions in LA County are prosecuted by about 15-20 lawyers at the most, and there are only about 5 competent "tenant" attorney's for residential cases.

Thanks for all of the PMs and help.  I do not need an eviction attorney, I need someone to file an answer to a brief in the appeals court.  At this time, my attorney defaulted on the timeframe and that is where it stands.  If the court allows his "excuse" of why he defaulted, I may be granted more time to answer the opening brief from the appellant.  If I am granted that time, I need someone who is capable of writing and filing the answer.

I just sent you an e-mail. I will call you this weekend to discuss (if you still need help that is).
