END OF MESSAGE

Every girl including myself left this "agency" (aka 1 sadistic/abusive 40 yr old guy/pimp) To get back at us he has blasted fake backpage ads with all unblurred real photos in numerous different cities attempting to expose us to friends and family. Essentially trying to ruin our reputation. The ads have been up for months. I have reported them countless times and emailed backpage and still they are up. Is there a way to get these ads taken down?

To stay away from BP for a while. He will see you aren't posting on there anymore, and will stop harassing you eventually.

create a new address and tell them someone got hold of your photos and is using them for improper purposes and they must cease and desist posting them at once or else you will seek legal counsel immediately.  See what they do.

First, scroll down a few topics and read the thread:
Subject: Rights to photos...

I cite this site: http://blog.kenkaminesky.com/photography-copyright-and-the-law/ which says:

"Copyrights and rights of privacy for people are different rights. When photographers take photos of people, they must be careful to not invade their privacy. This happens when someone enters a person’s private domain in a manner that would be considered offensive to the average person. ...

After the photo is taken, however, the photographer should be concerned with the person’s right of publicity. You violate a person’s right of publicity when, without permission, you use a photo of a person for your own benefit. ... “Commercial” use is different because the use benefits the photographer, so you need the person’s consent to use their image. If you get a model release signed by the subject, you are free to use the image commercially, i.e., for advertising. ..."

Your photo is a photo. Your image means "your likeness" or "you-ness"

It could be tough battle against a creep like that guy, but he appears to be using your image (even if he bought and paid for the photo shoot and owns the pics) ... he appears to be using your image for his benefit and your detriment by abusing your right to privacy. I'd say the unblurred face is solid proof of his deliberate intent to "out" you and break that veil to your privacy.

Does he have a signed model release from you and the others? If not, you might warn the websites that he is using your "image" against your wishes and in violation of your right to privacy. They might want proof of some sort (another picture in the same outfit with today's newspaper / date) that you are the person in the pics and not some random person trying to pull down ads from their site).

I think you will need a lawyer. Maybe you and the others can pool your complaints and get one lawyer to handle it as a package deal.

Final (desperate) suggestion. I don't know who you are or what your pics look like, but you could try emailing BP and the other sites and say, "So-and-so is using pictures of me TAKEN WHEN I WAS UNDER 18 YEARS OF AGE. HE WAS NOT SUPPOSED TO POST THOSE PICS and you can be prosecuted ... "  Can your pics pass for teenage pics?  They will disappear from the website about 3 seconds after they read your email.

Good luck

I have literally tried everything. The photos we not professional and not taken by a photography. There was no contract signed. I am young and my photos do look even younger. I did email the abuse email they provide and stated that I was only 16 when those photos were taken and that they were stolen. I reported them and emailed them endlessly and have not gotten even one response from the site. Thank you for your help, I'm guessing my next step is to contact my attorney.

Yep. Sounds like you need a lawyer at this point.

Among other things, he/she might approach BP with a threat based on US Code 2257 which is the record keeping law for sexually oriented materials. On many sexy modeling sites (and porn!), there are notices about "Keeper of Records" (usually some lawyer's office) and such to show PROOF that the model was over 18, sober, etc., when the pictures / videos were made.  The records are things like photocopies of license and passport, sometimes a video clip ("My name is Mary, I'm 20 yo, here is my license [zoom in]. I'm here today, DATE, to film a sexually explicit movie that will include .... I am sober and under no coercion to make this movie. ...")

Anyway ...

"Dear BP. I believe model Goddess to be underage. PLEASE PROVIDE PROOF (under Code 2257) THAT SAID MODEL IS OF LEGAL AGE. ..."  Of course, BP will not have any such records and neither will your old boss ... or does he? You know, I'm not sure if your lawyer can do that or if only government law enforcement can do that. LET YOUR LAWYER DO THE TALKING.

Anyway, I am surprised that BP is even willing to risk keeping borderline pics like yours on-line.

Good luck
