I have litigated numerous cases in this area. I'm not about to write a brief here, but I will say that the OP misstates the law regarding fair use and ignores a significant body of law regarding violations of rights of privacy. Providers should not worry on account of this ill-informed and misogynistic rant.

 No seriously I could give a flying fuck but yesterday I took my kid to the dentist.  And the hygienist came out and said would you sign the waiver so we can put her pic on the Facebook page for the (insert BS marketing ploy here).  BTW this hygienist was kinda hot.  I wanted to give her an oral exam.  See the pun there.  She is a hygienist and I wanted to give her ....anyway.  
   
 Then the other day I noticed a thread on the NYC forum about using pics without permission.  Being the nerd I am I decided to Google this phenomena.  And you know if it's on the Internet IT MUST BE TRUE!!!!  
   
 So here it goes:  Providers your pics can be used without your permission and here is why (read it and weep gals).  
   
 Fair use is a limitation and exception to the exclusive right granted by copyright law to the author of a creative work. In United States copyright law, fair use is a doctrine that permits limited use of copyrighted material without acquiring permission from the rights holders. Examples of fair use include commentary, search engines, criticism, parody, news reporting, research, teaching, library archiving and scholarship. It provides for the legal, unlicensed citation or incorporation of copyrighted material in another author's work under a four-factor balancing test.  
   
 The 4 factor test is kinda lengthy but let's put it this way.    
   
 I doubt a Hooker would be able to go into court and say "Judge, they stole my booty pics that I use to sell my Pussy to guys for $300 an hour and that's just wrong.  BTW disregard the fact that I am involved in illegal activity.  OK Judge.  Also I have an hour available for you if you have 2 references and $300, Ok judge.

So even though it's fair use and all, some things go beyond the pale, AFAIC.  For example:

Another provider used a pic of my friend (a pic so well-known, it's nearly her "signature) as the "welcome" photo on her site.

Couldn't help myself; I thought this was so wrong, I kept inundating her and all of her doubles partners with nasty emails until she took it down.

On another occasion, some girl tried to use a pic of my friend as her Twitter avatar.  I don't know, maybe it's "fair use", but I thought it was really dirty.  I think that girl stopped due to the public shaming from me, my friend, and my friend's other clients.


Sometimes "fair use" sucks.

And your quest for social justice continues by writing nasty emails and shaming people. Maybe you should have just let your "friend" know and let her/him handle it. What if your "friend" didn't want your help? People like you are a good part of what is wrong with this country. Put your phone down go outside and take a deep breath of fresh air and freedom. Try to shed a little bit of the manufactured outrage while your out there in the big bad scary world.

I don't annoy people who re-blog a photo or a snippet of one of her videos on tumblr--that's more or less fair use.

However:  Re-using another lady's pics as if to indicate that "if you buy that lady's time, you're getting the lady in the picture"--sorry, that's too much for me.

Obviously, I can't fight every battle all the time.  But I can try to look out for the best interests of a very close friend, can't I?

If you saw that a civvie friend was not being rewarded or recognized for work he/she had done, and credit was going to another person, and your friend was too distracted by other matters to handle it, wouldn't you consider stepping into the fray (for a very good friend)?

btw, don't ever lump me in with "social justice warriors".  AFAIC, social justice is to justice, as military music is to music.

The lawyer is correct - someone else using your booty pic on their ad to get business is not covered by fair use.  No question about it.   I am pretty sure this sort of thing has been litigated before.   BUT RT is actually right from a practical standpoint (as much as it pains me to admit it).  If you put a picture on your website - not much you can do about where it ends up - unless you have a ton of money to pay lawyers with - like Walt Disney, for example.  If you had a ton of money to pay lawyers with, you wouldn't be in this business

If so, then you're screwed, but it watermarks still work, then that's the way to avoid photo theft.

Someone with skill can edit them out or replace them.

Without giving away the secret of how to do this quickly and easily, let me just say that you would definitely be on the right track if you were to imagine how a "picture of a picture" couldn't possibly have the original picture's watermarks, same digital signature, or meta data in it.

It's not difficult if you know what you're doing. Just to be clear, I wasn't doing anything with the photos that would be a copyright violation.

About 5 years ago someone emailed me letting me know that an Indian Provider in London had stolen some of my photos. I went to her website and sure enough, she was using some of my pictures to advertise her services. Her website was a mess and I was livid upon seeing photos that I had paid such good money for and spent time and energy posing for on her website. With all the kindness I could muster (it was not much kindness as I really just wanted to kick her ass) I asker her to remove the photos before I got my "so called legal team" involved. I actually said a few very "unkind" things to her..but I felt I had every right after seeing my photos on her site. She quickly took them down and I was able to breathe a sigh of relief. It was a hugely ugly Karmic thing she did to herself and I really hope she reaps the fruits of her bad Karma. Can you see how sympathetic I am to her? LOL

Guys, if you happen to see another lady stealing pics of a provider please do contact the lady and make her aware of the situation. I was so grateful to have been notified so that I could take control and handle the whole debacle.

Sometimes a little razz-a-mattaz is all that's needed to get results.  It's called poker.

Gals should probably do a periodic internet search on their photos to see if they pop up in other places.

My pics get stolen all the time. I used to get more mad about it, now I just consider it a compliment and let it slide.

I've seen BP ads where they don't to remove watermarks (sorry Leon) I gotta laugh when the ad says DD blonde and there is a pic of a AA provider in mix of photos ... I know, that's just her tan, and I'm just a racist prick.

I have been to provider sites and right clicked to save a pic cause she was hot. I got the beat down and was told that function was disabled on that site. TRIO

that may be but for the average it is a deterrent and they will just move on to another pic to steal.

And this thread was already talking about photoshopping watermarks out, and a lot more elaborate things. Right click disabling is hardly a deterrant, and provides virtually zero security against photo theft.

Work around. Use an IPhone to save the pic. Email to yourself or ?

the clients. They can turn around and give it to a girl to use in ads.  

   I dont know but if another girl tryed to use my ics the guys would find out its not me when they show up, so she would look like an idiot by using a fake pic anyhow.
