I would pay special attention to the phrase "open to the public." That suggests that you'll need to "offer" to sell the tapes. Might I suggest really bad quality for a VERY high price, so while abiding by the law, only an idiot would want to pay for them.

Hmmm, idiot. That means that LE will start buying them. And if they start buying these really high priced, low quality videos, they won't have enough money left to run their lying ass operations. Boy, this idea sounds better all the time.

Appearently the Golden State is the only place in the US where its legal to make a porn film.

The Calif Penal code sez:

653.20. For purposes of this chapter, the following definitions apply:

(a) "Commit prostitution" means to engage in sexual conduct for money or other consideration, but does not include sexual conduct engaged in as a part of any stage performance, play, or other entertainment open to the public.

There was even a Supreme Court ruling that overturned a lower court conviction of a porn producer on charges related to prostitution. The opinion, CALIFORNIA v. FREEMAN, 488 U.S. 1311 (1989) written by the Justice O'Conner that said: " the prosecution of [Freeman] under the pandering statute must be viewed as a somewhat transparent attempt at an 'end run' around the First Amendment and the state obscenity laws."

So all you criminal justice lawyers out there, if I hire an provider to visit my hotel room with a camcorder so we can make a dirty movie, we do the act and video it, I pay her and she gives me the tape. Could we be arrested for prositution? On what grounds? If not, what other laws would prevent me from opening "Buck's Do it Yourself Adult Film Production LLC" to meet the need for artist expression by men traveling in California without their wives and girlfriends??

Any other thoughts on this approach? I sure got a strong urge to express myself artisticly. Anybody want to rent my videocam?

There once was, and possibly still is a place in los Angeles that did this. It was JT video. I think that there is a link on one of the first pages of this forum . I like the idea of video, but I don't think that the providers are up for it. Would one need a license to prove that he/she is going to sell the video??? I don't know.
  It would help if all providers willing to tape an encounter would post. Happy filming.
