Your question is more about police practices than about legalities.  Bikebryan is right that both types of session are illegal, but I don't know how much attention the police pay to FBSM providers.  Maybe they treat both the same, maybe not.

I'm sorry if this is an annoying message for those of you who have answered this question, but I wanted to know what the real risks are for someone who gets a sensual massage that ends with a happy ending.
If there is ever a sting- would you as a client be taken in or is the person providing the massage the only one who is really accountable.

Also, has there ever been a problem with a masseuse who has listed names and phone numbers of clients posting that information anywhere- have clients ever been arrested for that?

I have had a few massages from CL and never had a problem. for those of you who use CL as well- what are some tell tale signs that should alert me.

Also, I'm not into the GFE- I merely like the massages with a little kick- is this less dangerous than the GFE?

I would love to hear people's thoughts and I'm sorry if this is basic but it would be very helpful.

You are just as likely to get arrested for having a FBSM w/release as getting FS GFE.  In both cases, in the eyes of the court you are paying somebody for sexual relations.  Guilty.  Next case please.

one year ago today, I answered an age for erotic massage. the store owner told me that this law wasn't enforced and that they only did erotic massages on repeat customers. the police raided our place and this is what I found out in massage school.

massage is now considered a medical profession instead of an art form (dancing, dating).

there is a dress code for the massage therapist and the person being massaged has to under the sheets and properly draped or they could sue for being exposed. the genitals are to never be touched and the inner part of the thigh is too be avoided except in NMT and you massage the buttocks over the sheet.

many states require you to have a liscense and if there is anything sensual in the room or if the room has a lock on the door, the massage parlor can be tried for prostitution.

both the girls and the johns get arrested and depending on how good their lawyer is, they can get evicted.

I finished massage school and am getting my liscense within 3 months so that I don't have to charge extra for the incall. (tax write-off)

catch you getting a happy ending in exchange for $.  If you and the masseuse stick to the story that you were just getting a massage, you should be fine, although cops can arrest you just to hassle you.  

The masseuse is usually cited for doing business w/o a license.

Not true.  This statement is wrong in too many ways to explain here, but the widely-held belief that you can't be prosecuted unless the police see everything is not correct.

If police do see everything then the prosecutor will have a much easier case to prove, but a case can be brought and won with less evidence.  And though there are limits on when a suspect can actually be arrested for a misdemeanor, the lack of an arrest does not prevent prosecution.

I agree with sidone.  The reasons are to numerous to deliniate here, but just think about it - do you think the cops see every crime in progress before making an arrest?  In LA, masseuses are supposed to be licensed, and patrons are supposed to wear underwear, although I get a fair amount of legitimate massages, never wear anything, and have never had a masseuse ask me to put something on.  Nonetheless, what do you think a jury is going to infer from a man found naked on a massage table (or worse, bed) of a "masseuse" with no license (or formal training), in the "masseuse's" residence as opposed to a business, ~2 bills (maybe more, possibly a bit less) with your fingerprints on them after seeing the "masseuse's" internet ads?

My girlfriend got arrested when she was in a room naked with a customer. She was just rubbing his back and he was let go but I know that she went to jail. You can't offer massages unless you have a license to offer them and I mean a real massage license. I used to work at a place that offered massages but her license got taken away because according to the type of license she had she could only wash a man's face and neck. She couldn't even give body scrubs so you have to watch the terminology.
