The young lady in question and I were roommates for two years at boarding school...
She was cold hearted and mean then... this doesn't surprise me at all.
I am very sorry for the deceased's family's loss.

I dont know whether the drugs were forced but if not It may not be all her fault! Simply put Drugs are dangerous and bad!

Death it is the most logical outcome to injecting heroin. Use it... and prepare to die.

 
What if the tape shows the guy conscious and awake, allowing the girl shooting the drug into his vein?

 

I guess you could still be guilty of manslaughter, but I doubt the dope had an FDA warning.

You certainly bring up a valid point the defense will raise - that he consented to the injection. However, the video apparently shows him in medical distress and her doing nothing. The prosecution will argue that, because she gave him the injection (and, presumably, prepared the injection), she had a duty to give him aid and did not.  

If she took anything of value from the yacht, or attempted to cover up evidence of her presence (which, given the fact that she missed cameras located ALL OVER THE YACHT would be comical if it weren't so tragic), then you have another level of act, as hinted by the sheriff: second-degree murder. First-degree, of course, involves premeditation, which may yet still be shown (for example, if it can be shown she went there for the purpose of killing him via heroin), while second-degree involves gross negligence where you know or should know that bodily harm or death will result. Again, if she's been giving him injections, and knows that such injections could kill, they could charge second-degree.  

And I nearly choked when I read how he was a 'loving husband and father' - not sure the Mrs. really would share that opinion at this point

I'm guessing there will be a plea to voluntary manslaughter.

how do you know he showed signs of distress?

Can the tape/s be used as evidence, if the accused was unaware there were cameras?

Happens all the time, particularly in convenience store holdups, ATM thefts, etc. A business should (and in many jurisdictions, must) have a sign informing patrons they're being videotaped, but a private residence (and a yacht qualifies) does not have to have such a sign (and in reality, there are a number of occasions where you see a sign saying 'premises under video surveillance' and a camera nearby, but it's not actually hooked up to anything, just set up to look that way).

The problem with the video evidence - where a defense lawyer might get some wiggle room - is authentication. If the Mrs. was on the yacht, she could probably testify that the angle of the video was the same as a camera placed in such-and-such a place on the yacht, etc. But a number of cases have been won against red light cameras on authentication issues, and a good defense lawyer would probably try to use the same logic. Lack of consent to being videotaped might work, but I doubt it in this case.

As to the distress issue, it was mentioned by the Sheriff in one of the articles I read. It would also support the manslaughter charge - they would need to show the killing was unlawful and without malice (the legal definition is "the unlawful killing of another without malice"). She should have been charged with involuntary manslaughter (defined as a killing without malice "in the commission of an unlawful act, not amounting to a felony; or in the commission of a lawful act which might produce death, in an unlawful manner or without due caution or circumspection.") If the state can show malice, but not premeditation, then that would be second-degree murder.

Just google "most dangerous drugs ranking" and you'll see heroin at or near the top of every list. But when a person is rich and running low on new thrills, it must seem appealing.

No, the family doesn't deserve this outcome, but it's not solely this girls fault.  The guy played with fire and got burned.  This obviously wasn't his first rodeo, nor even his first time with this girl.  He's had his secret life going on for a while I'll bet.  You don't go from zero to Heroin, or from Church member to Hobbiest in just an instant, you work your way up.  

This girl was heartless for abandoning this guy when he was in distress and that certainly contributed to his death, but I don't think it's 'murder'.  

I've often wondered what would happen should have a heart attack or something while seeing a provider.  I just would hope I don't live thru it, because if I did, my SO would kill me anyway.
