I'm interested in hosting some adult parties in Honolulu and need some legal direction to minimize LE exposure. These parties would be hybrid swinger events that would include some high quality providers. It would be an invitation only event for select single females, single males and couples. The venue would be at a Waikiki suite or private beach house. A donation would be requested for the party and no promise of sex will be made.

Any legal advice to avoid LE problems?

For one thing, advertising "providers" is not smart.  Adding "donation" is another way of saying sex for money.

You cannot exchange sex for money or any other thing of value.  Period.  There is no linguistic silver bullet; no "clever legal move" as some other poster requested a few months ago.  Sex for money is illegal in the USA except in a few rural counties of Nevada and then under tightly controlled conditions.  It is a crime: a c-r-i-m-e for which one may be made to suffer publicly and privately.

Is that clear enough?

Oh yes.  One other thing.  Be sure to put your name, rank and serial number on the flyers and emails you send out for your little adult party.  Advertising that you're about to commit a few crimes is a sure way to avoid what you call "LE"; doubtless a cool term in hot Hawaii.

And you expect someone to advise you how to commit those crimes?  On a public posting board?  Ever hear of conspiracy, aiding and abetting?  Things like that?

Unless of course, YOU are LE.  Posts like yours should not be permitted by the moderators.

Last time I checked freedom of thought, expression and speech were still legal. If they weren't, anyone posting a review would be incriminating themselves. Discussion boards like this are a great excercise of these freedoms.

Since "provider" and "donation" seemed to be the big problem with my scenario, try this...

Private party with invited couples, single females and males.
Located in either a hotel suite or rented beach house.
No promise of sex.
Party admission is charged.
Consensual sex does take place at the party.

Legal or not?

Note: LE (law enforcement) is just an abbreviation. In Hawaii we sometimes refer to LE as 5-0.

Your original message is an invitation for someone to conspire with you to do an illegal act but to attempt to describe it as legal.  That is just not smart.  The 1st amendment has reasonable limitations such as shouting Fire in the movie house, inciting violence ans more.  It is not a license to discuss the commission of crime.

Rodmewell, why does a review which describes a commission of an illegal act not incriminate you? Is it protected speech? I always thought, possibly mistakenly, that physical evidence of a crime or the intent to commit a crime was required for a conviction not just discussing it.

It doesn't matter what evidence you have or have not, just don't thow a party around election time, that's what get these honchos(LE) get their hard ons.
