I was recently contacted by a detective of a large city in Southern Cali regarding a black book which he was investigating. At the time, the service did not know that they had possesion of it.
He explained to me that in CA, he has to be present and witness the act in order to make an arrest (even still, it'd only be a misdemenor). My lawyer later confirmed this, adding the additional assurance that since I live out of state, they wouldn't have any interest in pursuing me.
It's been a couple of months, and I haven't heard a thing from them. I'm pretty sure that I won't hear anything of it again.
I was wondering if in the event of LE sting operation...how far will LE go with the book list. I would think that as far as costs and resources go....they would proceed only with "day of sting" evidence and depending on agency/provider previous "criminal" record... case would be settled on Plea bargain basis...or plea of not guilty...whatever...
As for "black book" names.... therein lies my inquiry?
Posession or being caught in the act is 9/10th's of the law..Being in a black book could open a problem..only if they were to become forensic about payments..etc..to this provider and prove a trail to you..and most likely would not cause a problem..
Being in a book does not mean you are guilty..or at least in the way our system is works. If ever called..you are best to say.. nothing at all..and I mean nothing..or ever approached.Your response could come back to haunt you.
Besides, with a misdemeanor or infraction, one must be caught in the act. Not so a felony.
