Has the State Department released a smoking gun in the Hillary Clinton e-mail scandal? In a thread from June 2011, Hillary exchanges e-mails with Jake Sullivan, then her deputy chief of staff and now her campaign foreign-policy adviser, in which she impatiently waits for a set of talking points. When Sullivan tells her that the source is having trouble with the secure fax, Hillary then orders Sullivan to have the data stripped of its markings and sent through a non-secure channel.

18 US Code 107: "Concealment, Removal, or Mutilation Generally: Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both. ... and shall forfeit his office and be disqualified from holding any office under the United States."

I think the Clintons wrote the book on going right up to the line, standing on the line, stomping their feet on the line but NOT crossing the line, with any proof positive evidence.

I don't like Hills. That's a given. But I don't pull for her to go down like libs wanted Rove to be prosecuted. let the evidence fall where it falls. I don't root for her and don't root against her when it comes to law breaking. I just hope we get to the truth.

She can still be elected President and run the country from jail, maybe next to Governor Perry. LOL.   The Constitution provides the exclusive requirements for our presidents, and compliance with record keeping acts is NOT one of them. The Fox talking heads who claim otherwise and cite your “shall be disqualified from office” clause are simply wrong.

Aside from that, I don’t see any violation of the criminal records keeping statute on what has been reported so far, since the talking points were not "deposited or filed" with any public officer (they apparently were prepared by the staff) and the change to  the headers was not “unlawful” since the talking points were not classified information anyway
