He would have argued this if he had waived time. And I don't  think Rikers Island is in South Carolina. Maybe you should focus on cases where they actually apply the SC statute.

You haven't read the statute? The judge seemed to think that was kind of important.

Of course he shouldn't be granted bail!  A judge decided that he was a danger to the community and a flight risk.

He's been in jail since April, and now, nine months later, he's still awaiting trial.  But the trial won't begin until October of this year so the judge has now decided to grant bail and set it in the amount of $500,000.  The man put up 10% and was released.  He will be under house arrest and cannot have contact with the victim's family.

Why can't he sit in jail for a year and a half waiting for his trial when another has been sitting in jail for 5 years:

Why did the man receive a get-out-of-jail (relatively) free card while the others cited did not?  Because he's a fucking cop!!

Which ever way you look at the criminal justice system is pretty much a usless tool that does not serve to benefit anyone. The CJS can't even serve to benefit itself.

We should abandon this waste of resources.

(Hammonds) are going away for 5 years for a campfire - longer than many murderers.  

The close rate on homicides in inner cities like Baltimore and Chicago is less than 50%, sometimes much less.  Homicides there are going through the roof while embattled cops are too scared to get out of their cars and only react AFTER a crime is committed.  

1000 black-on-black murders to 1 cop murder and NOONE gives a shit.  I know that I don't anymore, it is the problem of those in those neighborhoods to solve, along with the leaders that they elect.  You get what you deserve, or vote for.  Life is hard, being stupid makes it harder.

I guess that Black lives, or other lives for that matter, don't really matter to liberals.  To them, it's not a problem to solve but to find someone other than themselves to blame it on.  Minority lost lives are merely collateral damage to them in their war to acquire and keep power.

Nice leadership, Barack.  He's black, right?

That is what I am afraid leadership has come to in this country.  Whoever has the loudest voice, biggest pulpit, and can tell folks who to blame for their woes.  But no actions to actually solve the woes.  But plenty of pandering.

I am not saying this is just a D or R issue, but I will say The POTUS is very good at it.

The gun issue may be a good example of the R's doing it.

But you know each case is different. The judge took into his decision the fact that there were no priors, limited flight risk and small chance of any recurring wrongdoing.

Is that enough? Idk. Only way to know would be to compare it to similar situations that have come in front of that judge before, but to say he got out early merely for being a cop is too simplistic, imo.

The defendant’s status as a cop has nothing to do with it; if that made a difference, the judge would not have denied bail last fall.

       The guy was arrested in April 2015 and now the trial has been scheduled for October 2016. That is more than a year and a half for someone who might be innocent.  (Speedy trial motion to dismiss incoming).

       Even where a prior motion to reconsider bond has been made, the statute expressly allows for a new motion to reconsider “based on the length of time the defendant has been held for trial after six months.”

          So the judge was just following the statute here, not favoring the cop.  And I’m sure I’m right on this one because there is a “Law and Order” episode directly on point. Det. Briscoe arrested this murderer who was denied bail but after 6 months the judge released  him on bail. McCoy said he was still a danger to the community but the judge said “what about due process.”

       True, the guy did go on a serial killing spree and escaped to Venezuela but that is television BP; this is real life. Try to keep these two apart. And while we are at it, I want you watch the Law and Order episodes on speedy trial rights, presumption of innocence, and annoying the judge with frivolous posts- I made motions

You said: "...the statute expressly allows..."   What statute?  Cite the title, section and chapter.  Does it apply to defendants charged with murder?  How do you know the cop didn't waive time?  OJ didn't - great move by Robert Shapiro to force the prosecution to go to trial before they had their ducks in a row.

What about the others who have been incarcerated for 5-8 years?  You got a motion for them?  I have a motion for you - it involves the middle finger of my hand.
